Crain and Vas li i,00 The following s wets absent: none M! 0*6 0*6 Councilmember Neils introduced the following Resolution and coved Its adoption: RFSOLUTION NO. 95- 810 APPROVING A CONDITIONAL USE PERMIT FUR FERNBY CORPORATION FOR ARBY'S ROAST BEEF RFST- AURANT AT 14420 29TH PLACE NORTH (85096) WHEREAS, Fernby Corporation has requested a Conditional Use Permit for Arby's Roast Beef Restaurant to allow the operation of a Class II restaurant including drive-through service at 14420 29th Place North; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request by Fernby Corporation for a Conditional Use Permit for Arby's Roast Beef Restaurant to allow the operation of a Class II restaurant including drive-throuqh service at 14420 28th Place North, subject to the following conditions: 1. The permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. 2. The permit is issued to the Fernby Corporation for "Arby's Roast Beef Restaurant" as operator of the facility and shall not be transferable. 3. The site shall be maintained in a sanitary manner. 4. All waste and waste containers shall be stored within approved designated areas as diagrammed on the plans dated September 13, 1985 5. Any signage shall conform with the City Ordinance standards and previous approvals which limits freestanding signage to the use of the combined sign located at High- way 55 and Fernbrook Lane. 6. There shall be no outside display, sales, or storage of merchandise or related materials. 7. The permit shall be renewed in one year to assure compliance with the conditions. S. All parking shall be off-street in designated areas which comply with the Zoning Ordinance. The notion for adoption of the foregoing Resolution was duly seconded by Councilmember Schneider , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport. Councilmembers Neils, Schneider, Crain and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
