The following members were present: Mayor Dayenpor�Councilmembersei sT , Schneider, Crain and Vasiliou The following members were absent: none a -w* t� tit Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 801 APPROVING PRELIMINARY PLAT AND VARIANCE FOR GRAHAM DEVELOPMENT COMPANY FOR LAKE PARK HEIGHTS (85089) WHEREAS, Graham Development Company has requested approval for a Preliminary Plat and Variance for Lake Park Heights for 17 single family lots on approximately 9.72 acres north of 29th Avenue and Trenton Lane; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Preliminary Plat and Variance for Graham Development for Lake Park Heights located north of 29th Avenue and Trenton Lane, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until a Contract has been awarded for sewer and water. 4. Provisions for a 30 ft. wide trail outlot along the east side of Lot 1, Block 1, per Comprehensive Park Plan, as verified by the Parks and Engineering Depart- ments, with submittal of detailed plans as to construction of the trail per City Standards. 5. Payment of park dedication fees -in -lieu of dedication with app'-opriate credits in an amount determined according to verified acreage and paving costs and ac- cording to the Dedication Policy in effect at the time of filing the Final Plat. 6. Street names shall comply with the City Street Naming System. 7. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. PLEASE SEE PAGE TWO . Page two Resolution No. 85- 801 S. No Building Permits shall be issued until the Final Plat is filed and recoroed with Hennepin County. 9. No yard setback variances are granted or implied. 10. Variances include a lot width variance for 108 ft. vs. 110 ft. for Lot 9, Block 1. 11. The minor collector roadway will be aligned as far westerly as possible, per approval of the City Engineer. 12. The Final Plat shall be reviewed by the Planning Commission and those persons who spoke at the Preliminary Plat Public Hearing shall be re -noticed of the Commission meeting. The notion for adoption of the foregoing Resolution was duly seconded by Councilmember Crain , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Neils, Schneider, Crain and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
