Pursuant to due call and notice thereof, a Special meeting of the City
Council of the City of Plymouth, Minnesota was held on the 23rd day

Councilmember Crain introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 85- 769
DECLARING ADEQUACY OF PETITION
AND ORDERING PREPARATION OF REPORT
PETITION FOR STORM SEWER - ROBERT MIDDLEMIST 4TH ADDITION
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLMOUTH, MINNESOTA:
1. A certain petition requesting the improvement of Robert Middlemist
4th Addition by the installation of storm sewer along the rear lot
line of Lot 5, Block 1, Robert Middlemist 4th Addition, filed with
the City Council on September 23, 1985 is hereby declared to be
signed by the required percentage of owners of property affected
thereby. This declaration is made in conformance to Minnesota
Statutes Section 429.035.
2. The petition is hereby referred to the City Engineer and he is in-
structed to report to the Council with all convenient speed advising
the Council in a preliminary way as to whether the proposed improve-
ment is feasible as to whether it should best be made as proposed or
in conjunction with some other improvement and the estimated cost of
the improvement is recommended.
3. The petitioners do waive their rights to public improvement hearings
and special assessment hearings on this improvement.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Neils , and upon vote being, taken thereon, the
following voted in favor thereof: Deputy Mayor Schneider, Councilmembers
Crain, Neils and Vasiliou
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
