Pursuant to due call and notice thereof, a Special meeting of the City
Council of the City of Plymouth, Minnesota was held on the 23rd day
40 of Se tember , 1985. The following members were present:

The following members were absent: Mayor Davenport
Councilmember Crain introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 85- 765
REDUCING DEVELOPMENT BOND
CREEKSIDE OF PLYMOUTH 2ND ADDITION (79018)
WHEREAS, in accordance with the development contract dated July 14, 1983, Dean R.
Johnson Construction, Inc., developer of Creekside of Plymouth 2nd Addition
(7.4018), has agreed to install certain improvements for said development; and
WHEREAS, the developer has completed a portion of the street, utility and site
grading as noted below; and
WHEREAS, thi-. developer has requested a reduction of the development bond to reflect
the completed work;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH
that the bonding requirements are reduced as follows:

Boulevard and Drainage Swale Sod
Pond or Ditch Construction
Street Signs
Street Sweeping and Storm Sewer Cleaning
Maintenance of Erosion and

Park and Trail Improvements
Design, Administration, Inspection, As-Builts

That the letter of credit required be reduced from $59,400 to $41,400 to reflect
the completed work.
FURTHER BE IT RESOLVED that the street construction and concrete curb and gutter is
accepted as of September 23, 1985 for the continual maintenance subject to the one
year guarantee by the developer.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Neils , and upon vote being taken thereon, the
following voted in favor thereof: Deputy Mayor Schneider, Councilmembers
Crain. Neils and Vasiliou
The following voted against or abstained: none
Whereupon the resolution was declared duly passed and adopted.
