Councilmembers Crain. Neils. and Vasiliou The following ambers were absent: Mayor Davenport Councilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION NO. 85-750 DENYING VARIANCES FROM THE SUBDIVISION CODE AND URBAN DEVELOPMENT POLICY RESOLUTION NO. 75-664 FOR ROBERT LAMSON (85084) WHEREAS, Robert Lamson has requested approval of Variances from the Subdivision Code and Urban Development Policy Resolution No. 75-664, to divide an 8 acre parcel located at 100 Black Oaks Lane by metes and bounds description rather than platting; and, that would not have frontage on a public road. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the division based on the following: 1. Compliance with the variance criteria has not been established. 2. The requested variances could be eliminated if the property were serviced with utilities from Plymouth, rezoned, and platted in accordance with the Subdivision Code subsequent to utility service being provided and in accordance with Metropolitan Waste Commission policies. 3. Compliance with Urban Development Policy Resolution No. 785-664 has not been established. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following voted in favor thereof: Dewy Mayor Schneider, Councilmembers Crain, Neils and Vasiliou The following voted against or abstained: pone Whereupon the Resolution was declared duly passed and adopted.
