Neils and Vasiliou The following members were absent: Mayne r Davenport Councilmember Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 746 APPROVING MIXED PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN/PLAT AND CONDITIONAL USE PERMIT FOR TRAMMELL CROW COMPANY' FOR PLYMOUTH BUSINESS CENTER FOURTH ADDITION (MPUD 79-1) (85044) WHEREAS, Trammell Crow Company has requested approval for a Mixed Planned Unit Devel- opment Preliminary Plan/Plat and Conditional Use Permit for two industrial sites north, west, and south of Annapolis Lane in the Criterion MPUD; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Mixed Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit for Trammell Crow Company for Plymouth Business Center Fourth Addition located north, west, and south of Annapolis Lane, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. i. No Building Permits shall he issued until a Contract has been awarded for sewer and water. 4. Payment of park dedicationfees-in-lieu of dedication in accordance with the Dedication Policy in effect at the time of issuance of Building Permit. 5. Park dedication requirements, per Development Contract requirements for Criter- ion MPUD shall be completed as part of this development and call for the trail along the west property boundary up to County Road 9 to be constructed. 6. Rezoning shall be finalized with filing of the Final Plat. 7. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. S. Yard setbacks shall be as shown on the PUD Plan. PLEASE SEE PAGE TWO • Page two Resolution No. 85- 746 9. Final Plat mylars shall refer to PUD No. 78-1. 10. The Final Plat shall respond to the City Attorney's title concerns. 11. The Final Plat application shall include final grading and landscape plans and shall be reviewed by the Planning Commission. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following voted in favor thereof: Deputy mayor Schneider, Councilmembers Crain, Neils and Vasiliou The following voted against or abstained: none ■hereupon the Resolution was declared duly passed and adopted.
