HomeMy WebLinkAboutCity Council Resolution 1985-734Pursuant to due call and notice thereof, a Special meeting of the City Council of the City of Plymouth, Minnesota was held on the 23rd day of September , 1985. The following members were present: The following members were absent: Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 734 AUTHORIZING THE VACATION OF STREET EASEMENT FOR ZACHARY LANE WITHIN THE NORTH 1/2 OF THE SOUTH 1/2 OF THE SOUTHWEST CORNER SECTION 12, TOWNSHIP 118 RANGE 22 WHEREAS, a petition was received to vacate a portion of Zachary Lane; and WHEREAS, a public hearing with respect to said vacation was scheduled and held on September 23, 1985 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of September 23, 1985; and WHEREAS, the Council did hold a public hearing on September 23, 1985 to inform any and all inter�:sted parties relevant to the vacation of said Zachary Lane; and WHEREAS, it was determined by the City Council that a portion of said right-of-way for Zachary Lane as described below is not needed for public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the following street easement be vacated: 1. That a portion of Zachary Lane described as follows is hereby vacated: All that portion of 'Zachary Lane which lies within the north 1/2 of the south 1/2 of the the southwest quarter of Section 12, Township 118, Range 22, Hennepin County, Minnesota Together with a permanent easement for slope and utility purposes across the tract or parcel of land lying and being in the County of Hennepin, State of Minnesota, described as follows, to wit: that dart of the north 1/2 of the south 1/2 of the southwest 1/4 of Section 12, Township 118 north, Range 22 west as follows: commencing at the southwest corner of the north 1/2 of the south 1/2 of the southwest 1/4 of Section 12; thence northerly along the west line of Section 12 for a distance of 340 feet; then easterly at right angles to said west line for a distance of 33 feet; thence southerly to a point in the south line of the north 1/2 of the south 1/2 of the southwest 1/4 of Section 12, distance 63 feet easterly of the southwest 1/4 thereof; thence westerly to the point of beginning and there terminating; accepting therefrom the right-of-way of the existing road (document No. 3643200) Resolution No. 85- 734 Page Two 2. That said vacation shall not affect the authority of any person, corporation or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, or water lines, mains and hydrants thereon or thereunder, to continue maintaining the same, or to enter upon such way or portion thereof vacated to repair, replace, remove otherwise attend to thereto. 3. That vacation shall not be filed until after the final plat of Deerwood Estates 5th Addition is filed in Hennepin County. The motion for the adoption of the foregoing Resolution was duly seconded by and upon vote being taken thereon, the fo owing voted in avor thereof: Deputy Mayor Schneider, Councilmembers Crain, Neils and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
