Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 16th day
of September , 10g5. The following members were present-714iWor Davenport,
Councilmembers Neils, Vasiliou, Schneider and Crain
The following members were absent: none
Councilmember Crain introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 85- 710
AUTHORIZING THE VACATION OF A PORTION OF XENIUM LANE
WITHIN WESTMINSTER ADDITION
WHEREAS, the petition to vacate a portion of Xenium Lane right-of-way was
received by the City Council; and
WHEREAS, a public hearing with respect to said vacation was scheduled for
September 16, 1985 in accordance with Minnesota Statutes 412.851 as amended;
and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of September 16, 1985; and
WHEREAS, the Council did hold a public hearing on September 16, 1985 to inform
any and all interested parties relevant to the vacation of said Zenium Lane;
and
WHEREAS, it was determined by the City Council that the portion of Zenium Lane
as described below is not needed for a public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA as follows:
1. That that part of Xenium Lane described below is hereby
vacated.
That part of Xenium Lane platted within the Westminster
Addition which lies between the north plat boundary; the
northerly right-of-way of 30th Avenue as extended westerly to
the northerly plat boundary; and the westerly line of Lot 1,
Block 1 of said Westminster Addition.
2. That the City of Plymouth reserves easement rights for drainage
and utility purposes over, under and across vacated street.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Schneider , and upon vote being taken thereon, the
following voted in favor thereof: Ma or Davenport, Councilmembers Neils,
Vasi1_iou, Schneider and Crain
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
