The following members were present: Mayor Davenport, Councilme ers rain • Neils, Schneider and Vasiliou The following members were absent: None Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 85-708 A RESOLUTION URGING MINNESOTA CONGRESSMEN AND SENATORS TO SUPPORT S. 1570 OR LEGISLATION OF SIMILAR INTENT WHEREAS, the Supreme Court decision in Garcia vs. the San Antonio Transit Authorit made the provisions of the Fair Labor Standards Act app ca a to virtudity all municipal employees; and WHEREAS, the application of the Fair Labor Standards Act to state and local employees has caused personnel costs to Increase without demonstrable protection to employees or the public; and WHEREAS, S. 1570 as proposed by Senator Don Nickles, Republican -Oklahoma, would: 01. Permit the exemption from Fair Labor Standards Act overtime pay requirements for state and local employees; and 2. Permit the use of compensatory time off in lieu of overtime compensation; and 3. Grant exempt status from the Fair Labor Standards Act for individuals who volunteer services for state and local government; and 4. Eliminate the retroactive application of federal fair labor standards to state and local government; NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Plymouth, Minnesota, that it should and hereby does urge Minnesota Congressmen and Senators alike to support S. 1570 or similar legislation to avoid substantial local government personnel cost increases and reduced flexibility in personnel administration without demonstrable benefit to state and local government employees. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon vote being taken thereon, t e following vote n favor thereof: Mayor Davenport, Councilmembers Crain, Neils, Schneider and Vasiliou hefollowing voted against or abstainech None Whereupon the Resolution was declared duly passecl and adopted.
