HomeMy WebLinkAboutCity Council Resolution 1985-667CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota, was held on the 9th day of September . 1985. The following members were present: Mayor Davenportt Councilmembers Neils, Schneider, Crain and Vasiliou The following members were absent: none Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 667 APPROVING CONDITIONAL USE PERMIT AMENDMENT FOR ARTHUR AND MARILYN ZENZEN TO ALLOW FOR REDUCED REAR YARD SETBACK WITHIN THE MISSION HILLS RPUD (850-9) WHEREAS, Arthur and Marilyn Zenzen have requested a Conditional Use Permit Amendment to allow for reduced rear yard setback within the Mission Hills RPUD at 3975 Balsam Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request by Arthur and Marilyn Zenzen for a Conditional Use Permit Amendment to allow for reduced rear yard setback within the Mission Hills RPUD at 3975 Balsam Lane, subject to the following conditions: 1. Appropriate building permits to be obtained prior to initiation of construction. 2. No other variances are granted or implied. 3. Approval is granted for a 21 ft. rear yard setback to the west property line based on the fact that an existing sliding glass patio door was installed in this residence; that the porch design is small; that the lot is on a cul-de-sac which reduces the rear yard; and, that the 4 ft. variance request will not have a large impact for this development. 4. The Amendment is based upon the findings that there is a terrain condition unique to this lot; a 12 ft. dimension is reasonable for a deck; the window presents a design constraint that renders relocation of the deck unreasonable; and the overall lot coverage will not exceed 20%. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Neils, and upon vote being taken thereon, the following voted n favor thereof:ayor Cyenport, Councilmembers Neils, The following voted against or abstained: Councilmember Crain Whereupon the Resolution was declared duly passed and adopted.
