Council of the City of Plymouth, Minnesota was held on the 26th day of August , 1985. The following members were present:�dyor Davenport, Councilmembers Crain Schneider and Vasiliou The following members were absent: Council—member Neils Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 650 REQUEST FOR PAYMENT NO. 6 AND FINAL 1984 UTILITY IMPROVEMENT PROJECT WHEREAS, the City of Plymouth as owner and Ceca Utilities, Inc., as contractor have entered into an agreement for the 1984 Utility Improvement Project, said agreement being dated July 9, 1984; and WHEREAS, the engineer has certified his acceptance of the work and his approval of the final request for payment: NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $363,139.10, three change orders were approved in the amount of $90,765.55 and the value of the . work to date is $445,976.46. 2. That the work performed by the contractor for the 1984 Utility Improvement Project and certified to the Council by the engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and correction of faulty work after final payment. 3. Request for Payment No. 6 and Final in the amount of $14,779.32 to Ceca Utilities, Inc. for the 1984 Utility Improvement Project is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon vote being talen thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers _ Crain. Schneider and Vasiliou The following voted against or abstained: none Whereupon the resolution was declared duly passes; an adopted.
