Schnpidpr and Vacilinu The following members were absent: CnunrilmPmhPr Np;lc CnuncilmPmhPr Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 644 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT AND APPROVAL FOR REAFFIRMATION OF SITE PLAN FOR PARKSIDE AT MEDICINE LAKE FOR PARKSIDE AT MEDICINE LAKE PARTNERSHIP (RPUD 76-1) (A-338) WHEREAS, the City Council has approved the Final Plat and Development Contract and Reaffirmation of Site Plan for Parkside at Medicine Lake as requested by Parkside at Medicine Lake Partnership; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: r1. Compliance with the City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time of issuance of Building Permit. 3. No Building Permits shall be issued ntil a Contract has been awarded for the con- struction of municipal sewer and water. 4. Removal of all dead or dying trees from the property at the owner's expense. 5. Submittal of required utility and drab,,,ge easements as approved by the City Engineer prior to filing the Final Plat. 6. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. 7. The Final Plat mylars shall contain a statement noting that the plat is part of the approved RPUD 76-1 per Section 9 of the Zoning Ordinance. S. Approved yard setbacks are per the RPUD Site Plan. 9. Private trails shall be constructer per City Standards. 10. Total maximum number of units shall be 211 designated on the approved plan. 0 PLEASE SEE PAGE TWO Page two Resolution No. 85- 644 • 11. Submission of required Site Improvements Performance Agreement and financial guarantee for completion of site improvements. 12. Signage shall be in compliance with the Ordinance. 13. All waste and waste containers shall be stored within the structures. The ■onion for adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Kayor Davenport, Councilmembers Crain, Schneider and Vasilio_, The following voted against or abstained: none ■hereupon the Resolution was declared duly passed and adopted.
