HomeMy WebLinkAboutCity Council Resolution 1985-624CITY OF PLYNDUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 19th day of August 1985. The following members were present: Mayor Davenport,�ouncilmembers Schneider, Crain and Vasiliou The following members were absent: Councilmember Neils few Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 85-624 APPROVING A CONDITIONAL USE PERMIT AND WAIVER FOR ALBER CONSTRUCTION COMPANY, INC. AT 4901 WEST MEDICINE LAKE DRIVE (85034) WHEREAS, Alber Construction Company, Inc. has requested a Conditional Use Permit and Variances for outside storage of equipment and vehicles associated with a non -conforming industrial use in the FRD (future restricted development) District at 4901 West Medicine Lake Drive; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request for Alber Construction Company, Inc., for a Conditional Use Permit and Variances for outside storage of equip- ment and vehicles associated with a non -conforming industrial use in the FRD (future restricted development) District,at 4901 West Medicine Lake Drive, subject to the following conditions: 1. The permit allows outside storage of 30 vehicles and equipment; use of the office; and, is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. 2. The permit is issued to the Alber Construction Company as operator of the facility and shall not be transferable. 3. The site shall be maintained in a sanitary manner. 4. There shall be no signage other than directional or nameplate signs, on the property. 5. Hours of operation shall be limited to 6:00 A.M. to 8:00 P.M. 6. The permit shall be renewed in one year to assure compliance with the conditions. 7. The requirement for paving the storage area is waived. PLEASE SEE PAGE TWO Page Two Resolution No. 85- 624 • 8. T~e maximum number of vehicles to be stored on this site shall be 30; all vehicles shall be associated to .Aber Construction Company. 9. The permit does not allow any manufacturing or production activity on the site, including major automotive repair or mixing of paving materials; nor does the permit allow any outside storage of merchandise, supplies, or parts. 10. Any fuels, lubricants, solvents, and the like shall be propertly stored, used, and disposed of in accordance with applicable Codes and Ordinances. 11. The parking areas for employees and visitors shall be paved in accordance with Ordinance provisions. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou, and upon vote being taken thereon, the following voted in favor thereof: Mayor avenport, Councilmembers Schneider. Crain and Vasiliou The following voted aciinst or abstained: none Whereupon the Resolution was declared duly passed and adopted
