CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota, was held on the 12th day of August 19JL5. The following members were present: Mayor Davenport, Councilmembers Neils. Schneider and Vasiliou The following members were absent: rnunr;lmomnar train 0*0 0* • Councilmember Schneider introdtK*d the following Resolution and moved Its adoption: RESOLUTION NO. 85- 583 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR FOX RUN 2ND ADDITION FOR LUNDGREN BROTHERS CONSTRUCTION COMPANY (85066) (MPUD 83-1) WHEREAS, the City Council has approved the Final Plat and Development Contract for Fox Run 2nd Addition as requested by Lundgren Brothers Construction Company= NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2 . Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 3. No Building Permits to be issued until the Final Plat Is filed and recorded with Hennepin County. 4. Appropriate legal documents regarding Homeowner Association covenants and restrictions addenduns shall be filed with the Final Plat. 5. The Final Plat mylars shall contain a statement noting that the plat Is part of the approved MPUD 83-1 per Section 9 of the Zoning Ordinance. 6. The future subdivision of Outlot A is subject to Ordinance required reviews and compliance with Resolution No. 83-464 which states that no Building Permits shall be issued beyond the intersection of 24th Avenue and Yuma Lane until Yma Lane is connected to Vicksburg Lane, or to Dunkirk Lane via a route other than 24th Avenue. The motion for adoption of the foregoing Resolutlem was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Neils. Schneider and Vasiliou lne Tollowing vorea against or anstained: none Whereupon the Resolution was declared duly passed and adopted.
