HomeMy WebLinkAboutCity Council Resolution 1985-567CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota was held on the 12th day of August 1985. The following members were present:Mavor Davenport, . Councilmembers Neils, Schneider and Vasiliou The following members were absent: Councilmember Crain Councilmember Schneider introduced the following Resolution and moved Tis adoption: RESOLUTION NO. 85- 567 AUTHORIZING THE VACATION OF 40TH AVENUE AND GOLDENROD LANE IN MISSION HILLS PARK 6TH ADDITION WHEREAS, a petition was received to vacate certain streets and utility ease- ments in Mission Hills Park 6th Addition; and WHEREAS, a public hearing with respect to said vacation was scheduled for August 12, 1985 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of August 12, 1985; and WHEREAS, the Cotncil did hold a public hearing on August 12, 1985 to inform any and all interested parties relevant to the vacation of certain streets and utility easemeLtE in Mission Hills Park 6th Addition; and WHEREAS, it was determined by the City Council that said streets and utility easements are not needed for public purposes; . NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the following streets and utility easements be vacated: 1. All of 40th Avenue North and all of Goldenrod Lane as dedicated in Mission Hills Park 6th Addition, according to the recorded plat thereof, Together with all side, front and rear lot lines and utilities ease- ments for all platted lots 1 through 12, Block 1 and Lots 1 through 2, Block 2 in the plat of Mission Hills Park 6th Addition. 2. That said vacation shall not take place until the final replatting of the Mission Hills Park 6th Addition is filed with Hennepin County. 3. That said vacation shall not affect the authority of any person, corporation or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, or watermains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove otherwise attended thereto. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: _Mayor Davenport, Councilmembers Neils, Schneider and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted. +1nt,t �rAnk �rkit
