Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 15th day
of July , 1985. The following members were present: Mayor Davenport,
Councilmembers Neils. Schneider. Crain and Vasiliou
The following members were absent: none
Councilmember Schneider introduced the following Resolution and moved
its adoption:
RESOLUTION N0. 85- 522
DECLARING PROPERTY TO BE SURPLUS AND AUTHORIZING THE MAYOR AND
THE CITY MANAGER TO EXECUTE A DEED CONVEYING
PART OF TRACT A, REGISTERED LAND SURVEY NO. 466 AS SURPLUS PROPERTY
WHEREAS, the City Council has approved a final plat for Tammie Middlemist
Addition, and;
WHEREAS, the approved preliminary and final plats include Part of Tract A,
Registered Land Survey No. 466, and;
WHEREAS, said Tract A, Registered Land Survey No. 466 was deeded to the City in
order that 47th Avenue North could serve other tracts in Registered Land Survey
No. 466 and terminates in a cul-de-sac, and;
WHEREAS, the Tammie Middlemist Addition plat provides for the extension of 47th
Avenue North via 49th Avenue North and eliminates the need for a cul-de-sac,
and;
WHEREAS, the City therefore has no need for said property,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, as follows:
1. That part of Tract A, Registered Land Survey No. 466 described as
follows is hereby determined to be surplus property: Commencing at a
point on the northerly line of said Tract A distant 109.46 feet
easterly, measured along said northerly line, from the most easterly
corner of Tract C in said Registered Land Survey; thence southerly
47.24 feet along the easterly line of said Tract A to the point of
beginning of land to be vacated; thence on a bearing of West, 78.84
feet to a tangential curve concave to the southeast, having a radius
of 20.00 feet and also being tangent to a line drawn parallel with and
distant 60.9n feet southeasterly of the easterly line of said Tract C;
thence southwesterly 20.58 feet along said curve, central angle 78
degrees 36 minutes 18 seconds; thence South 11 degrees 23 minutes 42
seconds West, 54.82 feet to the easterly line of said Tract A; thence
121.39 feet along said easterly line to the point of beginning. The
east line of said Registered Land Survey No. 466 is assumed to have a
bearing of North.
2. That the City Manager and Mayor are authorized to execute a deed
conveying the above described part of Tract A, Registered Land Survey
No. 466. to Robert E. Middlemist, Jr., owner and proprietor of Tammie
Middlemist Addition.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Neils 'and upon vote being taken thereon, the
following voted in favor thereof:Mayor Davenport. Councilmembers Neils,
Schneider Crain and Vasiliou
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
