HomeMy WebLinkAboutCity Council Resolution 1985-503CITY OF PLYMOUTH Pursuant to due call and notice thereof, a Regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 15th day of July , 1985. The following members were present: . Deputy Mayor Schneider, .o n ilmemb rs Crain_ Neils and Vasiliou The following members were absent: Miff Davenport Councilmember rJeils introduced the following Resolution and moved its adoption: RESOLUTION NO. 85-503 AUTHORIZING THE VACATION OF A PORTION OF COUNTY ROAD 61, ADJACENT TO CARLSON CENTER ADDITION WHEREAS, the petition to vacate a portion of County Road 61 adjacent to Carlson Center Addition was received by the City Council; and WHEREAS, a public hearing with respect to said vacation was set for July 15, 1985 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of July 15, 1985; and WHEREAS, the Council did hold a public hearing on July 15, 1985 to inform any and all interested parties relevant to the vacation of said County Road 61; and WHEREAS, it was determined by the City Council that County Road 61 adjacent to Carlson Center Addition as described below is not needed for a public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. That that part of County Road 61 described below is hereby vacated: Parcel 1 That par: of County Road No. 61, as dedicated in Carlson Companies Addition, according to the recorded plat thereof, described as follows: Beginning at the northwesterly corner of Outlot F, Carlson Center Second Addition, according to the recorded plat thereof, said corner is on the southeasterly line of said County Road No. 61; thence North 42 degrees 21 minutes 03 seconds East, assumed bearing, along said southeasterly line of County Road No. 61 (said southeasterly line is also the northwesterly line of said Outlot F) a distance of 309.84 feet to the northeast corner of said Outlot F; thence northwesterly a distance of 16.52 feet along a curve concave to the southwest having a central angle of 2 degrees 59 minutes 38 seconds, a radius of 316.10 feet and a chord bearing of North 25 degrees 03 minutes 58 seconds west; thence North 79 degrees 32 minutes L5 seconds west a distance of 63.66 feet; thence South 52 degrees 04 minutes 33 seconds West a distance of 117.78 feet; thence South 37 degrees 55 minutes 27 seconds East a distance of 12.00 feet; thence South 52 degrees 04 minutes 33 seconds West a distance of 20.00 feet; thence North 37 degrees 55 minutes 27 seconds West a distance of 12.00 feet; thence South 52 degrees 04 minutes 33 seconds West a distance of 57.81 feet; thence South 1 degree 28 minutes 50 seconds West a distance of 97.70 feet to the intersection with the northerly extension of the westerly line of said Outlot F; thence southerly a distance of 41.58 feet along said northerly Resolution No. 85- 503 Page Two extension which is a curve concave to the southwest having a central angle of 5 degrees 30 minutes 03 seconds, a radius of 433.10 feet and a chord bearing South 25 degrees 10 minutes 26 seconds East to the point of beginning. Parcel 2 County Road No. 15, as dedicated in Carlson Center Second Addition according to the recorded plat thereof, adjoining the south line of Outlot G, Carlson Center Second Addition. 2. That said vacation shall not affect the authority of any person, corporation or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, or water lines, mains and hydrants thereon or thereunder, to continue maintaining the same, or to enter upon such way or portion thereof vacated to repair, replace, remove otherwise attend thereto. 3. That the City of Plymouth reserves easement rights for utility purpose over and across said vacated street. The motion for the adoption of the foregoing Resolution was duly seconded by Deputy Mayor Schneider , and upon vote being taken thereoq th following voted in favor thereof: Deputy Mayor Schneider, Councilmemlers Crain, Neils and Vasiliou The following voted against or abstained: nune Whereupon the Resolution was declared duly passed and adopted.
