Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on--t!;W--T7S day of July 1985.
The following members were present: Deputy Mayor' Schneider, Council lmembers '
Crain, Neils and Vasiliou
were absent: Pmavor Uavenpor
Councilmember Crain introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 85-476
AUTHORIZING RELEASE OF SITE PERFORMANCE GUARANTEE FOR ABM CONTRACTORS FOR MERRIMAC LANE
TOWNHOMES (A-265)
WHEREAS, a Site Plan for ABM Contractors for Merrimac Lane Townhomes located at 1620
Merrimac Lane, was approved under City Council Resolution No. 74-410; and,
WHEREAS, the developer submitted the required Site Performance Guarantee in the form of
a Letter of Credit in the amount of $8,000.00; and,
WHEREAS, the City drew upon the Letter of Credit an deposited the $8,000.00 into
Account No. 401-000-285; and,
WHEREAS, upon notice from the developer, City staff has inspected said site and
recommends release of $8,000.00 from Account No. 401-000-285;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does authorize the release of Account No.
401-000-285 in the amount of $8,000.00 which was drawn to complete site improvements
for ABM Contractors for Merrimac Townhomes located at 1620 Merrimac Lane. The check
for this money shall he made out to "ABM Contractors and Commercial State Bank of St.
Paul".
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Neils , and upon vote beinq taken thereon, the
foliowina voted in favor thereof: 8eputy Mayor Schneider, Councilmembers Crain,
Neils and Vasiliou
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted
