HomeMy WebLinkAboutCity Council Resolution 1985-466CITY OF,PLYMOCTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 1st day of July , 1985. The following members were present: Deputy Mayor Schneider. Councilm m6 rc Crain, Neilc and Vacilinu The following members were absent: tier Oavpnnnrt Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 466 AUTHORIZING THE VACATION OF A PORTION OF JUNEAU LANE NORTH LYING SOUTHERLY OF 46TH AVENUE WHEREAS, a petition was received to vacate a portion of Juneau Lane lying South of 46th Avenue North was received by the City Council; and WHEREAS, a public hearing with respect to said vacation was scheduled for July 1, 1985 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of July 1, 1985; and WHEREAS, the Council did hold a public hearing on July 1, 1985 to inform any and all interested parties relevant to the vacation of said Juneau Lane North; and WHEREAS, it was determined by the City Council that Juneau Lane North lying South of 46th Avenue North as described below is not needed for a public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. Juneau Lane North described as follows is hereby vacated: All that part of Juneau Lane North in the plat of Ringsview Heights, Hennepin County, Minnesota, lying north of the following described line: Commencing at the northwest corner of said Outlot A; thence South 00°13'48" West 669.70 feet along the west line of said Outlot A; thence South 00°26'31" West 212.16 feet along said west line to the point of beginning of the line to be described; thence South 89°33'29" East 33.00 feet and said line there terminating. 2. That said vacation shall not affect the authority of any person, corporation or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, or water lines, mains and hydrants thereon or thereunder, to continue maintaining the same, or to enter upon such way or portion thereof vacated to repair, replace, remove otherwise attend thereto. 3. That the City of Plymouth reserves easement rights for utility purpose over and across said vacated street. 4. That said vacation shall not take place until the final plat of Ringsview Heights is filed at Hennepin County. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Crain , and upon vote being taken thereon, the following voted in favor thereof: Deputy Mayor Schneider, Councilmembers Crain, Neils and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted. ,tit*
