Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on fir= day of June 1935.
The following members were present: Mayor Davenport. Councilmembers gc nei er, —

Councilmember Vasiliou introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 85- 409
APPROVING WAIVER FOR HANS HAGEN HOMES FOR DEVELOPMENT OF MODFL HOME IN TYRELL ADDITION
PRIOR TO FINAL PLAN APPROVAL AND FILING OF FINAL PLAT (85037)
WHEREAS, Hans Hagen Homes has received approval if a Preliminary RPUD Plat/Plan for the
Tyrell Addition located east of Orchid Lane, north and south of 46th Avenue North; and,
WHEREAS, the petitioner has submitted an application for Final Plan/Plat approval which
requires review by the Planning Commission and City Council; and,
WHEREAS, the City Code requires filing of the Final Plat prior to issuance of Building
Permits; and,
WHEREAS, Hans Hagen Homes has requested a waiver which would allow issuance of Permits
for a four unit dwelling on proposed Lots 2, 3, 4, and 5, Block 1, Tyrell First
Addition, westerly of the intersection of Juneau Lane and 46th Avenue North so that
units would be available for the annual "Parade of Homes" event; and,
WHEREAS, the petitioner seeks permits for the model prior to review and approval of the
final plan and the filing of the final plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA that it should and hereby does approve the waiver for Hans Hagen Homes and auth-
orize the issuance of Permits for a four unit model home on proposed Lots 2, 3, 4, and
5, Block 1, Tyrell First Addition, subject to the following conditions:
1. There shall be no occupancy of the homes until all public improvements including
streets and utilities have been completed.
2. Use of the units for model purposes shall be subject to the Ordinance requirements
for model homes including provisions for signage and off-street parking.
3. An "As -Built" survey of the footing and foundation shall be submitted to the
Building Official for review and approval prior to any framing and construction
above grade.
4. Construction work and use of the homes for model purposes will be subject to the
City Erosion Control and Siltation Policy.

5. The development of this model home cluster shall be subject to the applicable Site
Plan and platting requirements for the Tyrell Addition and only the building
setbacks are confirmed at this time, per the graphics approved with the
Preliminary Plat by the City Council on May 20, 1985.
6. There shall be no further Building Permits issued in the Tyrell Addition until the
Final Plat has been filed and recorded at Hennepin County.
7. No other variances are granted or implied with respect to the Final Plan, Final
Plat, or Development Contract.
8. The required Site Improvements Performance Agreement and financial guarantee for
the attached housing portion of the Tyrell Addition should include this site.
The notion for adoption of the foregoing Resolution was duly seconded by
Councilmember Neils , and upon vote being taken thereon, UW
