HomeMy WebLinkAboutCity Council Resolution 1985-395CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 3rd day of June 1985 The following members were present: Mayor Davenport, Councilmembers Crain, Neils, — Schneider and Vasiliou The following members were absent: none Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 85-395 APPROVING PRELIMINARY PLAT, CONDITIONAL USE PERMIT AND VARIANCE FOR WALLACE CATES (85019) WHEREAS, Wallace Cates has requested approval for a Preliminary Plat, Rezoning, Vari- ance, and Conditional Use Permit for the development of approximately 24.19 acres to be divided into 19 single family residential lots located at 3220 Xenium Lane; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Preliminary Plat, Conditional Use Permit, and Variance for Wallace Cates for 19 single family residential lots on approximately 24.19 acres located at 3220 Xenium Lane; subject to the following: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until a Contract has been awarded for sewer and water. 4. Provisions for a 15 ft. wide trail outlot per Comprehensive Park Plan, as veri- fied by the Parks and Engineering Departments, with submittal of detailed plans as to construction of the trail per City standards. 5. Payment of park dedication fees -in -lieu of dedication with appropriate credits in an amount determined according to verified acreage and paving costs and ac- cording to the Dedication Policy in effect at the time of filing the Final Plat with Hennepin County. 6. Street names shall comply with the City Street Naming System. 7. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 8. Rezoning shall be finalized with filing of the Final Plat. 9. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. Minimum front yard setback shall be 35 ft., except along Xenium Lane which shall br. 50 ft.; side yard shall • be 10 ft. and rear yard shall he ?0 ft. except for Lots 1-4 which shall he 50 ft. from the Ordinary High Nater Level of Plymouth Creek. 11. Variance for the cul-de-sac length of 600 ft., vs. 500 ft., for 32nd Avenue North. 12. Access shall he limited to internal public roads and restricted from Xenium Lane. 13. Conditional use approval is granted for the development of 19 sinqle family detached homes consistent with the Preliminary Plat and General Development Plan. 14. Lots 1, 2, 12, 13, and 14 shall comply with the recommendations of the soils report dated May 10, 1985.
