HomeMy WebLinkAboutCity Council Resolution 1985-358CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the Mh day of May 1985. The following members were present: Mayor DavenpaRl 'Csuncilme r , Neils, Schneider and Vasiliou The following members were absent: none Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 85-358 APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR KINDER -CARE LEARNING CENTER (85011) WHEREAS, Kinder -Care Learning Center has requested approval of a Site Plan and Con- ditional Use Permit for the construction of an approximate 7,000 sq. ft. daycare center on Lot 1, Block 1 Montgomery 2nd Addition at the southwest corner of 45th .Avenue North and County Road 18 service road; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; ' NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THF CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for Kinder -Care Learn- ing Center for a Site Plan and Conditional Use Permit for construction of an approxi- mate 7,000 sq. ft. day care center on Lot 1, Block 1 Montgomery 2nd Addition, subject to the following conditions: 1. Compliance with City Engineer's Memorandum 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of Building Permit issuance. 3. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. 4. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements. 5. Any signage shall be in compliance with the Ordinance. 6. Any subsequent phases or expansions are subject to required reviews and approv- als per Ordinance provisions. 7. Compliance with the Ordinance regarding Fire Code requirements Including the location of fire hydrants and fire lanes. S. All waste and waste containers shall be stored within the enclosure and no out- side storage is permitted. PLEASE SEE NEXT PAGE Page two Resolution No. 85- 358 . 9. No Building Permit to be issued until the Final Plat is filed and recorded with Hennepin County. 10. The permit is issued to the Kinder -Care Learning Center as operator of the facility and shall not be transferable. 11. There shall be no outside display, sales, or storage of merchandise or related materials. 12. The permit shall be renewed in one year to assure compliance with the conditions. 13. A copy of the current State license shall be provided prior to issuance of the Permit; and a copy of subsequent current State licenses shall be kept on file with the City. 14. All portable playground equipment and materials shall be stored inside when not in use; and, the playground area shall be maintained in a clean and sanitary manner. 15. The fenced play area shall be secured during non -school hours to inhibit unauthorized access and use of any permanent equipment. 16. Exterior lighting of the premises shall be observed and evaluated by the City, with the intent of assuring that adequate illumination for security and emergency access purposes is provided prior to occupancy. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following voted in favor thereof: Mavor Davenport. Councilmembers Crain. The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
