HomeMy WebLinkAboutCity Council Resolution 1985-353CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 20th day of May . 1985. The following members were present: Mayor Davenport, Councilmembers Crain, Reils, Schneider and Vasiliou The following members were absent: none Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 85-353 APPROVING AMENDMENT TO RESIDENTIAL PLANNED UNIT DEVELOPMENT PLAN/PLAT AND CONDITIONAL USE PERMIT FOR HANS HAGEN HOMES FOR TYRELL ADDITION (RPUD 79-2) (79046) WHEREAS, Hans Hagen Homes has requested approval for a Residential Planned Unit Development Preliminary Plan/Plat Amendment for Amhurst Development (RPUD 79-2) for Tyrell .Addition for 44 townhouse units and enlargement of the lots for the remaining single family residential units located east of Orchid Lane, north and south of 46th Avenue North; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; OF NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Residential Planned Unit Devel- opment Preliminary Plan/Plat Amendment for Amhurst Development (RPUD 79-2) for Tyrell Addition for 44 townhouse units and enlargement of the lots for the remaining single family residential units located east of Orchid Lane, north and south of 46th Avenue North, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until a Contract has been awarded for sewer and water. 4. Payment of park dedication shall be consistent with the Amhurst 2nd Addition fees -in -lieu of dedication and shall he applied at the time of further final platting. 5. Street names shall comply with the City Street Naming System. 6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing anv open storm water drainage facility. 7. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. PLEASE SEE PAGE TWO W_ Page two • Pesolution No. 85- 353 8. All yard setbacks shall be consistent with the Amhurst RPUD approvals for single family units and per typical lot layout shown on the Preliminary Plat. 9. Final Plat mylars shall refer to RPUD No. 79-2. 10. Appropriate legal documents regarding Homeowner Association documents, covenants and restrictions as approved by the City Attorney, shall be filed with the Final Plat. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following voted in favor thereof: mayor Davenport, Councilmembers Crain, Neils, Schneider and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
