HomeMy WebLinkAboutCity Council Resolution 1985-345CITY OF PLYMOUTH Pursuant to due call and notice thereof, a reaular meeting of the City Council of the City of Plymouth, Minnesota was held on the 28th day of Mag , 1985. Councilmembers Crain, Neils, Schneider and Vasiliou The following members were absent: nnna CnunrilmamhPr Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 345 AUTHORIZING THE VACATION OF CERTAIN UTILITY AND DRAINAGE EASEMENTS HONEYWELL PROPERTY - SECTION 35, TOWNSHIP 118, RANGE 22 WHEREAS, a petition was received to vacate certain utility and drainage easements in Section 35, Township 118, Range 22, Honeywell property; and WHEREAS, a public hearing with respect to said vacation was scheduled for May 20 1985 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of May 20, 1985; and WHEREAS, the Council did hold a public hearing on May 20, 1985 to inform any and all interested parties relevant to the vacation of said utility and drainage easements in Section 35, Township 118, Range 22, Honeywell property; . and WHEREAS, it was determined by the City Council that said easements were no longer needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the following drainage and utility easements be vacated: A permanent sewer easement across the tract or parcel of land lying and being in the County of Hennepin and State of Minnesota, described as follows, to -wit: That part of the SW 1/4 of the NW 1/4 and the West 1/2 of the Southeast 1/4 of the NW 1/4 of Section 35, Township 118, Range 22 lying within a 20 foot strip of land the center line of which is described as follows: Commencing at a point on the South line of the SW 1/4 of the NW 1/4 distant 81.59 feet West of the SE corner of said SW 1/4 of the NW 1/4, thence Northwesterly along a line having a bearing of North 42° 15' 40" West for a distance of 239.83 feet to a point hereinafter referred to as "Point A", thence Northwesterly along a line having a bearing of North 16° 24' 40" West for a distance of 379.12 feet, thence Northeasterly along a line having a bearing of North 21° 35' 50" East for a distance of 367.22 feet, thence Northeasterly along a line having a bearing North 28° 35' 50" East for a distance of 400 feet, thence Northeasterly along a line having a bearing of North 260 44' 20" East to the North line of the Southeast 1/4 of the Northwest 1/4 and there terminating, and commencing at the above described "Point A", thence Southwesterly along a line having a bearing of South 41° 41' 20" West to the South line of said SW 1/4 of the NW 1/4 and there terminating as contained in Document Nos. 3688114, 3588115, and 3688119. Resolution No. 85-345 Page Two And a below described storm sewer easement on the parcel described as follows: Commencing at the center of Section 35, T118, R22; thence North 60.00 feet along the West line of the SW 1/4 of the NE 1/4 of said Section 35; thence East 472.71 feet along a line parallel with the South line of said SW 1/4 of the NE 1/4 and having an assumed bearing of S 89° 20' 05" E; thence North 938.0 feet at a bearing of N 0° 10' 06"; thence West 1120.23 feet at a bearing of N 89° 20' 05" W; thence South 998.0 feet at a bearing of S 0° 05' 53" W; thence East 646.30 feet to the point of beginning; and there terminating. Description of Easement: A permanent easement for storm sewer purposes over, under, across and through a strip of land 20 feet wide, within the above described parcel, the center line of which is described as follows, to -wit: Commencing at the center of Section 35, T118, R22; thence North 60.00 feet along the West line of said SW 1/4 of NW 1/4; thence East 472.71 feet along a line paral- lel with the South line of said SW 1/4 of NE 1/4 and having an assumed bearing of S 89° 20' 05" E; thence North 15.00 feet at a bearing of N 00 10' 06" E; to the true point of beginning of the centerline of the 20 foot wide utility easement; thence West along a line parallel to the South line of said SW 2/4 of NE 1/4 a distance of 40.0 feet; thence deflecting to the Northwest at an angle of 49°26' for a distance of 180.00 feet and there terminating centerline description of 20 feet wide easement. AND FURTHER BE IT RESOLVED that said easements shall not be vacated and filed with Hennepin County until the plat of Honeywell SSED final plat is filed with Hennepin County. The motion for the adoption of the foregoing Resolution was duly seconded by _Councilmember Schneider , and upon vote being taken thereon, the 10 following voted in favor thereof: Mayor Davenport. Councilme_mbe_rs Crain. Neils, Schneider and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
