Pursuant to due call and notice thereof, a Regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 20th day
of May 1985. The following members were present: Pta_vor Davenport,
The following members were absent: none
Councilmember Neils introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 85- 343
AUTHORIZING THE VACATION OF STREET EASEMENT IN
NE 1/4 OF THE SW 1/4 OF SECTION 9, TOWNSHIP 118, RANGE 22
WHEREAS, a petition was received to vacate a street easements in Section 9,
Township 118, Range 22; and
WHEREAS, a public hearing with respect to said vacation was scheduled for May
20, 1985 in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of May 20, 1985; and
WHEREAS, the Council did hold a public hearing on May 20, 1985 to inform any
and all interested parties relevant to the vacation of said street easement in
Section 9, Township 118, Range 22; and
WHEREAS, it was determined by the City Council that said easement is not needed
for public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA that the following street easement be vacated:
A perpetual easement for street purposes and for the purpose of constructing
and maintaining a turnaround over and across that portion of the North-
east Quarter (NE 1/4) of the Southwest Quarter (SW 1/4) of Section 9,
Township 118, Range 22, described as follows:
Commencing at the Southeast (SE) corner of the Northwest Quarter (NW 1/4)
of the Southwest Quarter (SW1/4) of said Section 9, Twp. 118, Range 22;
thence North along a line parallel to the West line of said Northwest
Quarter (NW 1/4) of the Southwest Quarter (SW 1/4) of said Section 9 a
distance of 65 feet to the point of beginning of the land herein
described; thence East, at right angles, along a line parallel to the
South line of said Northwest Quarter (NW 1/4) of the Southwest Quarter
(SW 1/4) of said Section 9 a distance of 50 feet; thence North, at right
angles, along a line parallel with the West line of said Northwest
Quarter (NW 1/4) of the Southwest Quarter (SW 1/4) of said Section 9 a
distance of 70 feet; thence West, at right angles, along a line parallel
with the South line of said Northwest Quarter (NW 1/4) of the Southwest
Quarter (SW 1/4) of said Section 9 a distance of 50 feet; thence South,
at right angles along a line parallel to the West line of said Northwest
Quarter (NW 1/4) of the Southwest Quarter (SW 1/4) of said Section 9 a
distance of 70 feet to the point of beginning of the land herein
described.
The motion for the adoption of the foregoing Resolution was duly seconded by
COuncilmember Crain , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Davenport, Councilmembers Crain,
Neils, Schneider and Vasiliou
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
