Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the 6th day of Ma 1985.
The following members were present: Mayor Davenport, Councilmember5 Neils,
Schneider. Crain and Vasiliou
The following members were absent: none
Councilmember Schneider introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 85-296
APPROVING SITE PLAN, CONDITIONAL USF PERMIT AND VARIANCE FOR WGK PROPERTIES, SEAL 'N
SHINE (85009)
WHEREAS, WGK Properties, Seal n' Shine, has requested approval of a Site Plan,
Conditional Use Permit and Variance for a full-service carwash to be located
approximately one block east of Nathan Lane, north of County Road 9; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the request for WGK Properties,
it Seal n' Shine, for a Site Plan, Conditional Use Permit and Variance for a
full-service carwash to be located approximately one block east of Nathan Lane, north
of County Road 9 subject to the following conditions:
1. Compliance with City Engineer's Memorandum
2. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of Building Permit issuance.
3. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations
for new structures on sites adjacent to, or containing any open storm water
drainage facility.
4. Submission of required financial guarantee and Site Performance Agreement for
completion of site improvements.
5. Any subsequent phases or expansions are subject to required reviews and approv-
als per Ordinance provisions.
6. No Building Permit to be issued until the Final Plat and documents allowing for
the shared drive are filed and recorded with Hennepin County.
7. The permit is subject to all applicable codes, regulations and Ordinances, and
violation thereof shall be grounds for revocation.

8. Compliance with applicable Building and Fire Code requirements shall be verified
by the City prior to Permit issuance.
9. Approved Variance: A waiver of the fire lane requirements along the east side
of the buildinq.
10. Any signage shall be in compliance with the Ordinance which includes limiting
wall signage to 96 sq. ft.
11. All waste and waste containers shall be stored within the enclosure, and no
outside waste storage is permitted. The enclosure gate shall be constructed per
Ordinance requirements.
12. The permit is issued to WGK Properties, Seal n' Shine as operator of the
facility and shall not be transferable.
13. The site shall be maintained in a sanitary manner and should the petitioner fail
to comply with this provision, management shall be notified of the irregularity,
and given 24 -hours to comply. In the event management does not comply, the City
shall proceed with the necessary corrective work and assess the cost against the
property.
14. There shall be no outside display, sales, or storage of merchandise or related
40 materials; there shall be no outside storage of vehicles overnight.
15. Hours of operation shall be limited to 8:00 A.M. to 8:00 P.M. Monday through
Saturday and 11:00 A.M. to 6:00 P.M. Sunday.
16. .%11 parking shall be off-street in designated areas which comply with the Zoning
Ordinance.
17. The facility shall be supervised by an employee during all open hours.
18. A berm will be installed with suitable landscaping in the front yard area on the
south side of the building; the purpose is to enhance screening from residential
areas, and the revised landscape/grading plans shall be approved by the
Community Development Department.
19. This Conditional Use Permit is not intended to be for the sale of vehicles. No
vehicles are to be parked for display and/or advertised for sale.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Vasiliou , and upon vote being taken thereon, the
following voted in favor thereof: mayor Davehport, Councilmembers Neils,
Schneider, Crain and Vasiliou
The following voted against or abstained: nnnp
Whereupon the Resolution was declared duly passed and adopted.
