Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 15th day of April , 1985. The following members were present: Mayor Davenport, Councilmembers Schneider, Neils, Crain and Vasiliou The following members were absent: none Councilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 260 APPROVING SITE PLAN, CONDITIONAL USE PERMIT AND V.RIANCES FOR PLYMOUTH SUPERETTE, INC. (94029) WHEREAS, Jack Wenner, Plymouth Superette, Inc. has requested approval of a Site Plan, Conditional Use Permit and Variances for installation of a gas pump island with a detached canopy to he located east of Highway 101 and southwest of Highway 55; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for Jack Wenner, Plym- outh Superette, Inc. for a Site Plan, Conditional Use Permit and Variances for in- stallation of a gas pump island with a detached canopy to be located east of Highway 101 and southwest of Highway 55, subject to the following conditions: 1. A waiver is granted from Resolution No. 75-664, and from the non -conforming land use provisions, as stated in Section 12 of the Plymouth Zoning Ordinance, on the bases that the proposed use is found to be accessory in nature and does not rep- resent an enlargement or expansion within the meaning and intent of the Ordinance. 2. Compliance with City Engineer's Memorandum. 3. Submission of required Site Performance Agreement and financial guarantee for completion of site improvements. 4. Signage shall be in compliance with the Ordinance, in that the painted wall sign shall be removed, the building signage shall be lowered so it is below the roof - line. The new pylon shall have a 20 ft. setback. 5. Any subsequent phases or expansions are subject to required reviews and approv- als per Ordinance provisions, including those applicable to non -conforming uses. 6. All waste and waste containers shall be stored within the approved enclosure, and no outside storage is permitted. 7. Approved Variances include: front yard setback of 46 ft. rather than 100 ft.; 0 and, side yard setback of 14 ft. rather than 50 ft. PLEASE SEE PAGE TWO Page two Resolution No. 85- 260 8. The Conditional Use Permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. 9. The permit is issued to the petitioner as operator of the facility and shall not be transferable. 10. The site shall he maintained in a sanitary manner. 11. There Shall he no outside display, sales, or storage of merchandise or related materials. 12. Approval is to allow the installation of gasoline service, and is not intended to allow or encourage the use of this site as a truck stop. Positive measures, to be approved by the City, shall be taken to discourage over -the -road semi -truck traffic. 13. No Building Permit shall he issued until the Lot Consolidation is filed and recorded with Hennepin County. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Crainand upon vote being taken thereon, the following voted in favor thereof: Mayor , avenport, Councilmembers Schneider, Neils, Crain and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
