The Fallowing members were present: Mayor Davenport,ouncilmembersc�hnelder, — Neils, Crain and Vasiliou The following members were absent: none Councilmember Vasiliou adoption: �f introduced the following Resolution and moved its RESOLUTION NO. 85- 257 APPROVING MIXED PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN/PLAT, AND CONDITIONAL USE PERMIT FOR BASS LAKE DEVELOPMENT COMPANY FOR "BASS LAKE ESTATES" AND "QUINWOOD COMMERCIAL CENTER) (MPUD 85-1) (84091) WHEREAS, Bass Lake Development Company has requested approval for a Mixed Planned Unit Development Preliminary Plan/Plat, and Conditional Use Permit for "Bass Lake Heights" and "Quinwood Commercial Center" (MPUD 85-1) for 88 single family lots, 1?_ twin lots and a service business site for 11 commercial lots on approximately 73.03 acres located in the northwest quadrant of Bass Lake Road and Hemlock Lane; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Mixed Planned Unit Development Preliminary Plan/Plat, Rezoning and Conditional Use Permit for Bass Lake Development Company for "Bass Lake Estates" and "Quinwood Commercial Center" (MPUD 85-1) located in the northwest quadrant of Bass Lake Road and Hemlock Lane, subject to the follow- ing conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying .sees from the property at the owner's expense. 3. No Building Permits shall be issued until a Contract has been awarded for sewer and water. 4. Provisions for a 30 ft. wide trail outlot per Comprehensive Park Plan, as veri- fied by the Parks and Engineering Departments, with submittal of detailed plans as to construction of the trail per City standards. 5. Payment of park dedication fees -in -lieu of dedication with appropriate credits in an amount determined according to verified acreage and paving costs and ac- cording to the Dedication Policy in effect at the time of filing the Final Plat with Hennepin County. 6. Street names shall comply with the City Street Naming System. PLEASE SEE PAGE TWO Page two Resolution Jo. 85- 257 7. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. R. Rezoning shall be finalized with filing of the Final Plat. 9. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 10. Yard setbacks for detached units are 30 ft. front yard; 20 ft. rear yard and 10 ft. to the sideyard for living area and 6 ft. to the side garage area. Setbacks for attached units are 30 ft. front yard; 20 ft. rear yard and 10 ft. side yard. Setbacks for residential units to Bass Lake Road, Hemlock Lane and North- west Blvd. are 50 ft. Commercial building setbacks are per Ordinance. 11. Private drive access shall be limited to internal public roads and restricted from: Bass Lake Road, Hemlock Lane and Northwest Blvd. 12. Transitional screening and berming shall be provided along: Bass Lake Road and Northwest Blvd.; final plans shall be submitted with the Final Plan/Plat application. 13. Final Plat mylars shall refer to MPUD No. 85-1. 14. Appropriate legal documents regarding Homeowner Association documents, covenants 10 and restrictions as approved by the City Attorney, shall be filed with the Final Plat; Also to be addressed are architectural controls, coordinated land- scaping and signage. 15. The PUD plan layout for the Quinwood Commercial Center shall be revised for the Final Plan/Plat stage to provide effective, more useable and suitably located common facilities than would otherwise be provided under conventional land dev- elopment and to demonstrate affirmative design efforts toward the preservation and enhancement of desirable natural site characteristics. The final plan shall be reviewed by the Planning Commission with the Final Plat/Plan for the Quinwood Commercial Center. Further direction is provided that the parking for the commercial area shall be located closer to 60th Avenue, and the residential lots located adjacent to existing developments shall be increased in area to provide transition. 16. Title concerns raised by the City Attorney shall be resolved prior to submitted of a Final Plan/Plat application. 17. Two 4 ft. by 8 ft. signs shall be placed at Bass Lake Road and future Northwest Boulevard and near 61st Avenue North and Hemlock Lane, showing the Concept Plan as approved by the Resolution, particularly noting future County Road 61. The notion for adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Schneider, Neils, Crain and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopt
