HomeMy WebLinkAboutCity Council Resolution 1985-241CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the let day of April , 1985. The following members were present: Deputy Mayor Schneider, Councilmembers Crain, Neils and Vasi iou The following members were absent: ayor avenport Councilmember Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 241 AUTHORIZING CONDEMNATION PROCEEDINGS PROJECT NO. 509 - STREET AND UTILITY IMPROVEMENTS NIAGARA LANE FROM HIGHWAY 55 TO COUNTY ROAD 6 WHEREAS, the City of Plymouth has undertaken Project No. 509; and WHEREAS, in order to construct the improvements certain permanent and temporary easements are required; and WHEREAS, the City Council finds it necessary, proper and expedient in the interests of the public health, convenience and general welfare of the citizens of the City of Plymouth for the City to acquire said easements; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the City Attorney is hereby authorized to commence condemnation proceedings for Project No. 509 for the following described easements within the following described parcels: . Parcel 21-118-22-42-0006; Lot 1, Block 1, Circle Star Business Center 2nd Addition Legal Description: A perpetual easement for public right-of-way purposes over, under and across the following described land: Lot 1, Block 1, Circle Star Business Center 2nd Addition, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County. Said easement lies northwesterly and northerly of the following described line: Commencing at the southwest corner of said Lot 1; thence north along the west line of said lot a distance of 345.00 feet to the point of beginning of the line to be described; thence deflect right 5 degrees 50 minutes 06 seconds to the northeasterly line of said Lot 1 and there terminating. Together with a temporary easement for construction purposes over, under and across the west 25.00 feet of said Lot 1. Parcel 21-118-22-42-0013; Lot 2, Block 1, Circle Star Business Center 2nd Addition Legal Description: A temporary easement for construction purposes over, under and across the west 30.00 feet of the following described land: That part of Lot 2, Block 1, Circle Star Business Center 2nd Addition according to the plat thereof on file or of record in the office of L'Ie Registrar of Titles in and for said County, lying Westerly of a line drawn parallel with and 298.27 feet East of the West line of said Lot 2 (said distance measured at a right angle to said West line of Lot 2). Resolution No. 85- 241 Page Two iParcel 28-118-22-31-0001; unplatted Legal Description: A perpetual easement for public right-of-way purposes over, under and across the following described land: All that part of the West One-half (1/2) of Section Twenty-eight (28), Township One Hundred Eighteen (118), Range Twenty-two (22), West of the 5th Principal Meridian, described as follows, to -wit: Beginning at a point in the East line of said West One-half (1/2) of said Section Twenty-eight (28); distant Two Thousand Four Hundred Seventy-nine and 5/10th (2,479.5) feet South of the Northeast corner of said West One-half (1/2) of said Section; thence South along the East line of said tract Three Hundred Sixty-three (363) feet; thence at right angles West One Hundred Twenty (120) feet; thence North parallel with the said East line of the West One-half (1/2) of said Section Twenty-eight (28) a distance of Three Hundred Sixty-three (363) feet; thence East One Hundred Twenty (120) feet to the place of beginning, according to the duly recorded plat thereof, together with the streets and alleys adjacent thereto, vacated or to be vacated which lies northwesterly of the following described line: Beginning at a point on the west line of the above described land distant 98.00 feet south of the northwest corner thereof; thence northeasterly to a point on the north line thereof distant 24.50 feet east of said northwest corner thereof. Together with a temporary easement for construction purposes over, under and • across that part of the above described land lying northwesterly of the following described line: Beginning at a point on the west line of the above described land distant 220.00 feet south of the northwest corner thereof; thence northeasterly to a point on the north line thereof distant 45.00 feet east of said northwest corner thereof. Parcel 28-118-22-31-0003; unplatted Legal Description: A perpetual easement for public right-of-way purposes over, under and across the following described land: All that part of Government Lot 3, Section 28, Township 118 North, Range 22 West embraced in the following described tract or parcel of land: Commencing at the Northeast corner of the Northwest Quarter of said Section 28, Township 118, Range 22, thence South on the East line thereof 2,479.5 feet; thence at right angles west 120 feet; thence at right angles south 1,089 feet to the actual point of beginning;said last described course hereinafter to be referred to as line "A"; thence at right angles East 120 feet to the East line of said Government Lot 3; thence South on said last mentioned line to the center line of Hennepin County State Aid Highway Number 6; thence southwesterly along said centerline to the point of intersection with the Southerly extension of the Lbove described line "A"; thence northerly to the point of beginning. Resolution No. 85- 241 Page Three is Said easement lies westerly, southerly and southwesterly of the following described line: Beginning at said actual point of beginning of the above described land; thence south along the west line of said land a distance of 80.00 feet; thence deflecting left 90 degrees 00 minutes 00 seconds a distance of 20.00 feet; thence deflecting right 70 degrees 00 minute 00 seconds to the south line of the above descsribed land and said line there terminating. Togethet with a temporary easement for construction purposes over, under and across the above described land; said easement lies westerly, southerly and southwesterly of the following described line: Beginning at the actual point of beginning of the above described land; thence south along the west line of said land a distance of 15.00 feet; thence deflection left 25 degrees 00 minutes 00 seconds to the south line of sai' above described land and said line there terminating. Parcel 21-118-22-43-0013; Lot 9, Block 2, Circle Star Business Center 2nd Addition Legal Description: A temporary easement for construction purposes over, under and across the west 35.00 feet of the following described land: That part of Lot 9, Block 2, lying northerly of a line drawn parallel with and 164 feet south of the north line of said Lot 9 (said distance measured . at right angles to the north line), Circle Star Business Center 2nd Addition, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County. The motion of the adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Deputy Mayor Schneider, Councilmembers Crain. Neils and Vasiliou The following voted against or abstained: Whereupon the Resolution was declared duly passed and adopted.
