HomeMy WebLinkAboutCity Council Resolution 1985-240CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Ccuncil of the City of Plymouth, Minnesota was held on the 1st day of April , 1985. The following members were present: OPputy Mayor Schneider. Councilmembers Crain Neils and Vasiliou The following members were absent: Mayor Davenport Councilmember Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 240 AUTHORIZING CONDEMNATION PROCEEDINGS PROJECT NO. 505 XENIUM LANE - 34TH AV -'NUE TO NORTH LINE OF HERITAGE WEST ADDITION STREET AND UTILITIES WHEREAS, the City of Plymouth has undertaken Project No. 505; and WHEREAS, in order tc construct the improvements certain permanent and temporary easements are required; and WHEREAS, the City Council finds it necessary, proper and expedient in the interests of the public health, convenience and general welfare of the citizens of the City of Plymouth for the City to acquire said easements; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF . PLYMOUTH, MINNESOTA that the City Attorney is hereby authorized to commence condemnation proceedings for Project No. 505 for the following described easements within the following described parcels: Parcel 15-118-22-34-0001: Unplatted Description of Parcel: That part of the Southwest 1/4 lying Esterly of U.S. Highway 494, except cartway, all in Section 15, Township 118, Range 22, Hennepin County, Minnesota. Description of Easement: A permanent easement for street and utility purposes over, under and across that part East of the following described line; Com- mencing at the SE 1/4 of SW 1/4 of Section 15, Township 118, Range 22; thence West along the South line of SW 1/4 a distance of 30 feet; thence North parallel to the East line of said SW 1/4 a distance of 625 feet; thence curving to the right tangential having a radius of 800 feet to its intersection with the East line of said SW 1/4 and there terminating. Together with a temporary construction easement for slope purposes over, under and across that part East of the following described line: Commencing at the SE 1/4 of SW 1/4 of Section 15, Township 118, Range 22; thence West along the South line of SW 1/4 a distance of 75 feet; thence North parallel to the East line of said SW 1/4 a distance of 625 feet; thence curving to the right tangential having a radius of 800 feet to its intersection with the East line of said SW 1/4 and there terminating. Resolution No. 85- 240 Page Two Parcel 22-118-22-12-0001; Unplatted Description of Parcel: The North 1/4 of the Northwest 2/4 of the Northeast 1/4, except cartway, all in Section 22, Township 118, Range 22, Hennepin County, Minnesota. Description of Easement: A permanent easement for street and utility purposes over, under and across the East 13.5 feet of the West 30 feet of the above described pa -cel. Together with a temporary construction easement for slope purposes over, under and across the East 30 feet of the West 60 feet of the above described parcel. Parcel 22-11b-22-12-0002; Unplatted Description of Parcel: The South 1/2 of the North 1/2 of the Northwest 1/4 of the Northeast 1/4, subject to road, all in Section 22, Township 118, Range 22, Hennepin County, Minnesota. Des,-ription of Easement: A permanent easement for street and utility pu�,_!s over, under and across the East 13.5 feet of the West 30 feet of the above described parcel. . Together with a temporary construction easement for slope purpose'•. over, under and across the East 35 feet of the West 65 feet of the above described parcel. Parcel 22-118-22-31-0001; Unplatted Gcription of Parcel: The North 150 feet of the East 290 feet of the ichwest 1/4, except cartway, all in Section 22, Township 118, Range 22, ,ninepin County, Minnesota. Description of Easement: A permanent easement for street and utility purposes over, under and across the West 13.5 feet of the East 30 feet of the above described parcel. Together with a temporary construction easement for slope purposes over, under and across the West 25 feet of the East 55 feet of the above described parcel. Parcel 22-118-22-21-0001; Unplatted Description of Parcel: Commencing at the bclttheast corner of North 1/4 of Northwest 1/4; thence North to a point 150' South from Northeast corner thereof; thence West 290 feet; thence North 150 feet; thence West to Easterly line of Highway No. 494; thence Southwesterly along said Highway line to 'south line of North 1/4 of Northwest 1/4; thence East to beginning, subject to road, all in Section 22, Township 118, Range 22, Hennepin County, Minnesota. Resolution No. 85- 240 Page Three Description of Easement: A permanent easement for street and utility purposes over, under and across the West 13.5 feet of the East 30 feet of the above described parcel. Together with a temporary construction easement for slope purposes ever, under and across the West 55 feet of the East 85 feet of the above described parcel. The motion for the adoption of the foregoing Resolution was duly seconded by CnllnrilmPmh r Vaciliou , and upon vote being taken thereon, the following voted in favor thereof: Deputy Mayor Schneider. Councilmembers Crain- NPilc and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
