HomeMy WebLinkAboutCity Council Resolution 1985-221• CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the _1st day of April . 19 a. The following members were present: DeputX„J�yor Schn id r, Counci.lmamhPrs Crain - WPils and Vasilinu The following members were absent: Mayor Davenport CnuncilmPmhPr Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 85-221 APPROVING SITE PLAN AND VARIANCES FOR M & K PROPERTIES, AIRPORT BUSINESS PARTNERSHIP FOR BUILDI14G A (85008-A) WHEREAS, M & K PROPERTIES has requested approval of a Site Plan and Variances for a 44,556 sq. ft. office/warehouse facility to be located on Parcel A, on the southwest corner of Fernbrook Lane and 2.3rd Avenue North; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; • NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for M & K Properties for a Site Plan and Variances for a 44,556 sq. ft. office/warehouse facility to be located on Parcel A, on the southwest corner of Fernbrook Lane and 23rd Avenue North, subject to the following conditions: 1. Compliance with City Engineer's Memorandum 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of Building Permit issuance. 3. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements. 4. Any signage shall be in compliance with the Ordinance. 5. Any subsequent phases or expansions are subject to required reviews and approv- als per Ordinance provisions. 6. All waste and waste containers shall be stored within the enclosure, and no out- side storage is permitted. The enclosure gate shall be constructed per Ordin- ance requirements. 7. No Building Permit to be issued until the Lot Division is filed and recorded with Hennepin County. 0 PLEASE SEE PAGE TWO Page two Resolution No. 85- 221 9. Approved Variances include: waiver of side yard setback requirements for peeking and drive aisles to allow for shared and combined facilities. 9. Appropriate legal documents, as approved by the City Attorney, shall be filed on the property, allowing for the shared and combined drive and parking facilities. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Deputy Mavor Schneider, Councilmembers Crain, Neils and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
