HomeMy WebLinkAboutCity Council Resolution 1985-196CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 18th day of March . 1985. The following members were present: Mayor Davenport, Councilmembers Schneider, Neils, Crain and Vasiliou The following members were absent: none Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 196 APPROVING MPUD FINAL PLAT, SITE PLAN, CONDITIONAL USE PERMIT AND VARIANCE FOR DALE BERTHIAUME FOR LE DALE PLAZA (MPUD 78-1) (84023) WHEREAS, Dale Berthiaume has requested approval of a Final Plat, Site Plan, Conditional Use Permit and Variance for an approximate 5,000 sq. ft. multi -use retail and service facility located south of County Road 9 and north and east of Annapolis Lane in the Criterion MPUD (Outlot A); and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for Dale Berthiaume for an MPUD Final Plat, Site Plan, Conditional Use Permit and Variance for an approximate 5,000 sq. ft. multi -use retail and service facility located south of County Road 9 and north and east of Annapolis Lane in the Criterion MPUD, subject to the following conditions: 1. Compliance with City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with Dedi- cation Policy in effect at the time of Building Permit issuance. 3. Provisions for a 30 ft. wide trail easement per comprehensive Park Plan, as verified by the Parks and Engineering Departments, with submittal of detailed plans as to construction of the trail per City standards. 4. Submission of required financial guarantee and performance agreement for comple- tion of site improvements. 5. All signage shall be in compliance with the Ordinance. 6. Any subsequent phases of expansions are subject to required reviews and appro- vals per Ordinance provisions. 7. Compliance with Ordinance regarding the location of fire hydrants. A variance is approved from the fire lane requirements per the December 4, 1984 Memorandum from the Fire Inspector. PLEASE SEE PACE TWO • Page Two Resolution No. 85- 196 8. All waste and waste containers shall he stored within the structure and no outside storage is permitted. 9. The existing slab and foundation shall be removed at the developer's expense. 10. The conditional use permit is subject to all applicable codes, regulations and Ordinances and violation thereof shall be grounds for revocation. 11. The site shall be maintained in a sanitary manner. 12. There shall be no outside display sales or storage of merchandise or related materials. 13. Hours of operation shall he within the period, 7:00 A.M. to 11:00 P.M. every day. 14. No Building Permits shall be issued until the Final Plat is filed and recorded at Hennepin County. 15. Approval includes a waiver of the setback to the east property line for the drive aisle. 16. Twelve Spruce trees, a minimum of 8 ft. high shall be added along Annapolis Lane 10 to enhance the screening of the development from residential properties to the west; and, if necessary trees may be located in the City right-of-way on the west side of Annapolis Lane. The motion for adoption of the foregoing Resolution was duty seconded by Co ncilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Schneider, Neils Crain and Vasiliou The following voted against or abstained: none .Whereupon the Resolution was declared duly passed and adopted.
