Pursuant to due call and notice thereof, a meeting of the City
. Council of the City of Plymouth, Minnesota was held on the 4th day
of March , 1985. The following members were present:
Mayor Davenport, Councilmembers Crain Schneider and Vasiliou
The following members were absent: Counc i I member- Nei s
Councilmember Schneider introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 85- 176
AUTHORIZING CONDEMNATION PROCEEDINGS
PROJECT NO. 427
SCHMIDT'S GARDENS STREETS AND UTILITIES
WHEREAS, the City of Plymouth has undertaken Project No. 427; and
WHEREAS, in order to construct the improvements certain permanent and temporary
easement} are required; and
WHEREAS, the City Council finds it necessary, proper and expedient in the
interests of the public health, convenience and general welfare of the citizens
of the City of Plymouth for the City to acquire said easements;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, Minnesota, that the City Attorney is hereby authorized to commence
. condemnation proceedings for Project No. 427 for the following described
easements within the following described parcels:
1) Parcel 18-118-22-21-0017; Lot 6, Block 2, Schmidt's Gardens:
A permanent easement for utility purposes across the south 6 feet of the
above described parcel.
A temporary slope easement for construction purposes across the north 19
feet of the south 25 feet of the above described parcel.
2) Parcel 18-118-22-21-0018; Lot 7, Block 2, Schmidt's Gardens:
A permanent easement for utility purposes across the north 6 feet of the
above described parcel.
A temporary slope easement for construction purposes across the south 19
feet of the north 25 feet of the above described parcel.
3) Parcel 18-118-22-21-0022; Lot 11, Block 2, Schmidt's Gardens:
A permanent easement for utility purposes across the east 10 feet of the
above described parcel.
A temporary slope easement for construction purposes across the west 5 feet
. of the east 15 feet of the above described parcel.

4) Parcel 18-118-22-21-0023; Lot 12, Block 2, Schmidt's Gardens:
A temporary slope easement for construction purposes across the west 20
feet of the above described parcel.
5) Parcel 7-118-22-34-0003; Lot 1, Block 2, Schmidt's Gardens:
A permanent easement for utility purposes over that part of Lot 1, Block 2,
Schmidt's Gardens described as follows: Commencing at the northwesterly
corner of said Lot 1, Block 2, Schmidt's Gardens; thence southeasterly
along the northeasterly line of Lot 1, Block 2, Schmidt's Gardens a
distance of 60 feet; thence deflecting 90° southwesterly along a line to
its intersection with the west line of said Lot 1, Block 2, Schmidt's
Gardens and there terminating.
6) Parcel 18-118-22-21-0003; Lot 1, Block 1, Schmidt's Gardens:
A permanent easement for utility purposes across the southerly 15 feet of
the above described parcel.
A temporary easement for construction purposes across the northerly 10 feet
of the southerly 25 feet of the above described parcel.
A temporary slope easement across the west 10 feet of the south 115 feet of
tt.e above described parcel.
7) Parcel 18-118-22-21-0002; R.L.S. No. 65 "D", Section 18, Township 118,
10 Range 22, Hennepin County:
A temporary easement for kconstruction purposes over that part of R.L.S.
No. 65 "d", in said Section described as follows: Comencing at the
southwesterly corner of R.L.S. No. 65 "D"; thence northeasterly along the
westerly line of said parcel a distance of 20 feet; thence deflecting 90'
southeasterly along a line a distance of 20 feet; thence deflecting 90'
southwesterly along a line to its intersection with the southerly line of
said R.L.S. No. 65 "D" and there terminating.
8) Parcel 18-118-22-21-0030; Lot 2, Block 1, Schmidt's Gardens:
A temporary easement for construction purposes across the north 10 feet of
the above described parcel.
A temporary slope easement aecross the west 10 feet of the above described
parce 1.
9) Parcel 18-118-22-21-0005; Lot 3, Block 1, Schmidt's Gardens:
A temporary slope easement across the west 10 feet of the above described
parcel.

1* 10) Parcel 18-118-22-21-0015; Lot 4, Block 2, Schmidt's Gardens:
A temporary slope easement across the east 10 feet of the above described
parcel.
11) Parcel 18-118-22-21-0016; Lot 5, Block 2, Schmidt's Gardens:
A temporary slope easement across the east 10 feet of the above described
parcel.
The above described temporary easements shall expire on December 31, 1986 or
upon completion of construction, whichever occurs first.
The motion for the adoption of the foregoing Resolution was duly seconded by
. Cnuncilmemher Crain , and upon vote being taken tbereon, the
following voted in favor thereof: Mayor Dayennort. COLM61MOMbers Crain.
