Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the 4th day of March 1985.
The following members were present: Mayor Dayenpor, ouncilmem ersrarity,—
Schneider aid Vasiliou.
The following members were absent: Councilmember Neils

Councilmember Crain introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 85- 154
APPROVING PRELIMINARY PLAT AND VARIANCES FOR ROBERT GERSBACH FOR MEDICINE LAKESHORE
ADDITION (84107)
WHEREAS, Robert Gersbach has requested approval of a Preliminary Plat and Variances
for Medicine Lakeshore Addition for 3 single family residential lots on 2.08 acres at
2540 West Medicine Lake Drive; and,
WHEREAS, the Planning Commission has reviewed the requests at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the Preliminary Plat and Variances
for Robert Gersbach for Medicine Lakeshore Addition for 3 single family residential
lots located at 2540 West Medicine Lake Drive, subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's expense.
3. Provisions for a 30 -ft. wide trail outlot per Comprehensive Park Plan, as veri-
fied by the Parks and Engineering Departments, with submittal of detailed plans
as to construction of the trail per City standards.
4. Payment of park dedication fees -in -lieu of dedication with appropriate credits
in an amount determined according to verified acreage and paving costs and ac-
cording to the Dedication Policy in effect at the time of filing the Final Plat
with Hennepin County.
5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open storm
water drainage facility.
6. No Building Permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.
7. Approved variances are:

8. No yard setback varances are granted or implied for any new structures or
0 additions.
9. The existing structure on proposed Lot 2 shall be removed prior to filing of the
final plat.
10. Resolution No. 82-467 is hereby rescinded.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Schneider, and upon vote being taken thereon, the
following voted in favor thereof: Mayor 5,Z port, Councilmembers Crain,
Schneider and Vasiliou.
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
