Pursuant to due call and notice thereof, a special meeting of the City
Council of the City of Plymouth, Minnesota was held on the 25th day
of February , 1985. The following members were present: Mayor Davenport,
• councilmembers Schneider, Crain and Vasiliou
The following members were absent: Councilmember Neils
Councilmember Schneider introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 85- 129
AUTHORIZING THE VACATION OF UTILITY AND DRAINAGE EASEMENTS
LOTS 3, 4, 5, 9, 10 AND 11, BLOCK 2, CIRCLE STAR BUSINESS CENTER FIRST ADDITION
WHEREAS, a petition was received to vacate utility and drainage easements on
Lots 3, 4, 5, 9, 10 and 11, Block 2, Circle Star Business Center First
Addition; and
WHEREAS, a public hearing with respect to said vacation was held on
February 25, 1985 in accordance with Minnesota Statutes 412.851, as amended;
and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of February 25, 1985; and
WHEREAS, the Council did hold a public hearing on February 25, 1985 to inform
any and all interested parties relevant to the vacation of said utility and
drainage easements across Lots 3, 4, 5, 9, 10 and 11, Block 2, Circle Star
Business Center First Addition; and
WHEREAS, it was determined by the City Council that said easements are not
needed for public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA that the following drainage and utility easements be
vacated:
1. A non-exclusive easement for utility and drainage purposes over
under, across and through the east 30 feet of Lots 3 and 11,
Block 2, Circle Star Business Center First Addition, files of
the Registrar of Titles, Hennepin County, Minnesota. Said
easement is recorded as Document No. 1144505; and
2. The utility and drainage easements as shown and dedicated on
each side of the lot line dividing Lots 3 and 11, except the
west 30 feet of said lots, on each side of the lot line dividing
Lots 4 and 10, except the east 11.25 feet of said lots, Block 2,
Circle Star Business Center First Addition, files of the
Registrar of Titles, Hennepin County, Minnesota; and

. 3. A perpetual easement for utility and drainage purposes over,
under and across the West thirty-five (35) feet of the East
forty-six and twenty-five hundredths (46.25) feet of Lots Five
(5) and Nine (9), Block Two (2), Circle Star Business Center
First Addition according to the plat thereof on file and of
record in the office of the Register of Deeds in and for
Hennepin County, Minnesota.
4. Said vacation shall not be filed at Hennepin County until the lot
consolidation is filed.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Vasiliou , and upon vote being taken thereon, the
following voted in favor thereof: mayor Davenport. Councilmembers Schneider.
Crain and Vasiliou
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
