HomeMy WebLinkAboutCity Council Resolution 1985-114CITY OF PLYMOUTH Pursuant to due call and notice thereof, a Regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 4th day of Fphri,arv�: 1�r- The following Albers were present: De a y Malinr SrhnPi Liar. rniinr i l mamhprc train_ Neils and Vasilinu The following members were absent: Maynr navpnnnrt Councilmemher Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 114 APPROVING PRELIMINARY PLAT FOR ROBERT MIDDLEMIST FOR TAMMIE MIDDLEMIST ADDITION (84052) WHEREAS, Robert Middlemist has requested approval of a Rezoning and Preliminary Plat for a 26 single family lot subdivision of 13.07 acres located northeast of West Medicine Lake Drive and 47th Avenue North; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Preliminary Plat for Robert Middlemist for Tammie Middlemist Addition a 26 single family lot subdivision of 13.07 acres located northeast of West Medicine Lake Drive and 47th Avenue North, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until a contract has been awarded for sewer and water. 4. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat. 5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 6. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 7. No yard setbacks are granted or implied. 10 PLEASE SEE PAGE TWO Page two Resolution No. 85- 114 S. The Final Plat shall not be acted upon until Metropolitan Council approval has been granted for the Comprehensive Plan Amendment related to the Staged Growth Element. 9. All public road right-of-way identified on the Preliminary Plat shall be dedicated to the City with the Final Plat, consistent with City plans and Ordinances. The motion for adoption of the foregoing Resolution was duly seconded by �y Mayor , and upon vote being taken thereon, the following voted in favor thereof: Deputy Schneider.Councilmembers Crain. Neils and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
