HomeMy WebLinkAboutCity Council Resolution 1985-113CITY OF PLYMOUTH Pursuant to due call and notice thereof, a Regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 4th day of February . 1985. The following members were present: Deputy Mayor Schneider, Councilmember5 Crain, Neils and Vasiliou The following members were absent: Mayor Davenport Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 85-113 APPROVING MASTER PLAN, SITE PLAN, CONDITIONAL USE PERMIT AND VARIANCES FOR ADVANCE MACHINE AT 14600 21ST AVENUE NORTH (A-519) WHEREAS, Advance Machine has requested approval of a Master Plan, Site Plan, Conditional Use Permit and Variances for expansion of their building, and for outside storage at 14600 21st Avenue North; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; . NOW, THEREFORE, DE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for Advance Machine for a Master Plan, Site Plan, Conditional Use Permit and Variances for the expansion to the facility located at 14600 21st Avenue North, subject to the following conditions: 1. Compliance with City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with Dedi- cation Policy in effect at the time of Building Permit issuance. 3. Submission of required financial guarantee and performance agreement for comple- tion of site improvements. 4. Subsequent phases or expansions are subject to required reviews and approvals per Ordinance, and to the approved Master Plan. 5. All waste and waste containers shall be stored within the approved enclosure. 6. The Conditional Use Permit is for the temporary outside storage of pallets and shipping containers; and, is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 7. The Conditional Use Permit is issued to the petitioner/tenant as operator of the facility and shall not be transferable. PLEASE SEE PAGE TWO Page two Resolution No. 85- 113 8. The site shall be maintained in a sanitary manner, and all waste and waste containers shall be stored within approved designated areas as diagrammed on the plans dated August 24, 1984, including the existing site. 9. The Conditional Use Permit for outside storage shall be renewed in one (1) year to assure compliance with the conditions. 10. Future development of this site shall be consistent with the approved Master Plan, staff dated August 24, 1984. 11. Appropriate legal documents establishing a covenant on the property shall be approved by the City Attorney, and filed at Hennepin County identifying that the future use of the building may require the construction of a parking ramp to satisfy Ordinance parking requirements, and use of the buildings and land will he governed accordingly. 12. Approved Variances include: a.) Lot Coverage as per the submitted Master Plan at 46.2% rather than 40%; and, b.) The landscape plan shall contain 172 plantings which meet the minimun, size requirements of the Landscape Policy, plus a variance to allow 38 plantings at . 1 inch minimum caliper to provide screening of the east and west perimeters; and c.) Landscaping will be installed with each phase per approved plans and the Planning Commission and City Council reserve the right to evaluate the landscaping with each phase of the development, for purposes of determining whether any variations from the Landscape Policy are warranted. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Crain , and upon vote being taken thereon, the following voted in favor thereof: Deputy Mayor Schneider, Councilmembers Crain, Neils and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
