HomeMy WebLinkAboutCity Council Resolution 1985-109CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 4th day of Fphruarx , 1985. The following members were present: The following members were absent: May ā‘avpnnnrt rnunrilmpmhpr Npils introduced the following Resolution and moved its adoption: RESOLUTION NO. 85-109 ORDERING IMPROVEMENT AND PREPARATION OF PLANS AND SPECIFICATIONS 47TH AVENUE ADJACENT TO TAMMIE MIDDLEMIST ADDITION STREET AND UTILITY IMPROVEMENTS PROJECT NO. 504 WHEREAS, Resolution No. 85-23 of the City Council, adopted the 7th day of January 1985, fixed a date for a public hearing with respect to utility and street improvements for 47th Avenue adjacent to Tammie Middlemist Addition; and WHEREAS, the proposed project includes the installation of watermain, sanitary sewer, storm sewer and street improvements for 47th Avenue adjacent to Tammie Middlemist Addition; and WHEREAS, ten days published notice of the hearing through two weekly publica- tions of the required notice was given and the hearing was held thereon the 4th day of February 1985, at which time all persons desiring to be heard were given a opportunity to be heard thereon; . NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH: 1. Such improvement is hereby ordered as proposed in the Council Resolution adopted January 7, 1985. 2. Bonestroo, Rosene, Anderlik 6 Associates is designated as engineer for the improvements. They shall prepare plans and specifications for the making of such improvement. 3. The plans and specifications shall not be started until the owners of the Tammie Middlemist Addition enter into a developer's agreement with the City of Plymouth or Bob Middlemist has posted a financial guarantee to reimburse the city for costs incurred if the project is not awarded. The motion for the adoption of the foregoing Resolution was duly seconded by . Deputy Mayor Schneider , and upon vote being taken thereon, the following voted in favor thereof: Deputy Mayor Schneider, Councilmembers Crain, Neils and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
