HomeMy WebLinkAboutCity Council Resolution 1985-106CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 4th day of February , 1985. The following members were present: 0Deputy Mayor Schneider Councilmembers Crain, Neils and Vasiliou The following members were absent: Mayor Davenpo=r * *** **-A Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 106 AUTHORIZING THE VACATION OF UTILITY EASEMENTS IN THE N.E. 1/4 OF N.E. 1/4 SECTION 36 WHEREAS, a request to vacate certain easements in the N.E. 1/4 of the N.E. 1/4 of Section 36 (Banner Engineering) was received by the City Council; and WHEREAS. a public hearing with respect to said vacations was scheduled for February 4, 1985 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of February 4, 1985; and WHEREAS, the Council did hold a public hearing on February 4, 1985 to inform all interested parties relevant to the vacation of said utility easements; and WHEREAS, it was determined by the City Council that said utility easements are not necessary for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: That the following utility easements are hereby vacated: 1. An easement for drainage and utility purposes over, under and across the east and north (excepting that portion hereinafter described which is parallel to the spur track) 6 feet and the south 10 feet of the following described property: That part of the Northeast Quarter of the Northeast Quarter of Section 36, Township 118 North, Range 22 West of the Fifth Principal Meridian, bounded and described as follows: Commencing at the intersection of the East line of said Quarter -Quarter Section and the North line of the South 30 ft. thereof: thence Westerly along said North line a distance of 525 feet to the point of beginning of the parcel of land herein described; then continuing Westerly along the North line of the South 30 feet of said Quarter -Quarter Section, a distance of 272.5 feet; thence Northerly along a line parallel with the East line of said Quarter -Quarter Section a distance of 405.6 feet; thence Easterly along a line parallel with the South line of said Quarter -Quarter Section, a distance of 37 feet, more or less, to a point distant 9 feet Southwesterly measured radially, from the centerline of the presently located spur track; thence Southeasterly along a line parallel with said spur track to a point on a line drawn parallel with the East line of said Quarter -Quarter Section through the point of beginning; thence Southerly along said last described parallel line a distance of 180 feet, more or less, to the point of beginning. An easement for drainage and utility purposes over, under and across the west and north 6 feet and the south 40 feet (except the south 30 feet) of the following described property: That part of the Northeast 1/4 of the Northeast 1/4 of Section 36, Township 118, Range 22, described as follows: Commencing at a point on the South line of said Northeast 1/4 of Northeast 1/4 distant 797.5 feet West of the Southeast corner thereof; thence North parallel with the East line of said Northeast 1/4 of the Northeast 1/4 a distance of 435.6 feet; thence West parallel with the South line of said Northeast 1/4 of the Northeast 1/4 a distance of 100 feet; thence South parallel with the East line of said Northeast 1/4 of the Northeast 1/4 to the South line thereof; thence East along the South line of said Northeast 1/4 of the Northeast 1/4 to the point of beginning. BE IT FURTHER RESOLVED that said vacations will not be filed with Hennepin County until such time that the final plat for Banner Engineering is filed with Hennepin County. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Vasil iou , and upon vote being taken thereon, the following voted in favor thereof: Deputy Mayor Schneider, Councilmembers Crain, Neils and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
