Pursuant to due call and notice thereof, a regular meeting of the City
• Council of the City of Plymouth, Minnesota was held on the 21— day of
1985. The following members were resent:

Cnunr_ilmpmh r N ils introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 85-96
REQUEST FOR PAYMENT NO. 5 AND FINAL
18TH AVENUE/FOX FOREST ADDITION
PROJECT NO. 122
WHEREAS, the City of Plymouth as owner and Northdale Construction Company as
contractor have entered into an agreement for the 18th Avenue/Fox Forest
Addition Improvements, said agreement being dated July 25, 1983; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payemtn;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the orginal contract amount ws $349,168.70, one change
• order was approved in the amount of $1,184.00 and the value
of the work to date is $333,662.29.
2. That the work performed by the contractor for Project No. 122,
and certified to the Council by the engineer as acceptable be
and the same is hereby released from the contract except as
to the conditions of the performance bond, any and all legal
rights of the owner, required guarantees and corrections of
faulty work after final payment.
3. Request for Payment No. 5 and Final in the amount of $23,787.87
to Northdale Construction Company for Project 122 is hereby
approved and the City Finance Director is hereby authorized
and directed to pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
. Councilmember Schneider , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Davenport, Councilmembers Crain,
Neils, Schneider and Vasiliou
The following votes against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
