HomeMy WebLinkAboutCity Council Resolution 1985-030CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 7th day of January , 1985. The following members were present: Mayor Davenport, TounctImembers Crain, Neils, Schneider and Vasiliou The following members were absent: Councilmember Neils introduced the following Resolution and moved its adopt= n* RESOLUTION NO. 85-30 AUTHORIZING CONDEMNATION PROCEEDINGS PROJECT 455 - STORM WATER POND BC -t'13 WHEREAS, the City of Plymouth has undertaken Project No. 455; and WHEREAS, in order to construct the improvements certain permanent and temporary easements are required; and WHEREAS, the City Council finds it necessary, proper and expedient in the interests of the public health, convenience and general welfare of the citizens of the City of Plymouth for the City to acquire said easements; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the City Attorney is hereby authorized to commence condemnation proceedings for Project No. 455 for the following described easements within the following described parcels: Parcel No. 1 (P.I.D. 15-118-22-11-0003) Legal Description: That part of the Northeast Quarter of the Northeast Quarter of Section 15, Township 118, Range 22 lying North of the South 829.5 feet thereof and that part of said South 829.5 feet lying East of the West 200 feet thereof, except roads. Easements: A permanent easement for storm water ponding purposes over, under and across that part of the above described parcel described as follows: Commencing at the NE corner of Section 15, thence southerly along the east line of said section having an assumed bearing of N 1°38'50"E a distance of 735 feet; thence 140 feet along a line having a bearing of S 58°30'W; thence 162 feet along a line having a bearing of West; thence 231 feet along a line having a bearing of N 62°30'W; thence 127 feet along a line having a bearing of N 22°3J'W; thence 79 feet along a line having a bearing of N 10°W; thence 95 feet along a line having a bearing of N 14°E; thence 112 feet along a line havi�g a bearing of N 30°E; thence 111 feet along a line having a bearing of N 45°E; thence 192 feet along a line having a bearing of N 83°E; thence 2)0 feet along a line having a bearing of S 65°E; thence East along a line to its intersection with the east line of Section 15 and there terminating; and A permanent utility and drainage easement over, under, across and through that part of the above described parcel described as follows: Commencing at the NE corner of Section 15, thence southerly along the east line of said section a distance of 300 feet; thence deflecting to the right 90° a distance of 25 feet; thence deflecting to the right 90° a distance of 300 feet; thence deflecting to the right 90° to the point of beginning and there terminating; and Resolution No. 85-30 Page Two A temporary construction easement over, under, across and through that part of the above described parcel described as follows: Commencing at the NE corner of Section 15; thence southerly along the east line of said section a distance of 300 feet; thence deflecting to the right 90° a distance of 100 feet; thence deflecting to the right 90° a distance of 300 feet; thence deflecting to the right 90' to the point of beginning and there terminating; and The above described temporary easement shall expire on December 31, 1986 or upon completion of construction, whichever occurs first; and A permanent easement for utility and drainage purposes over, under, across and through that part of the above described parcel which lies 20 feet on each side of the following described line: Commencing at the NE corner of Section 15; thence southerly along the east line of said section having an assumed bearing of N 1°38'50E a distance of 735 feet; thence 140 feet along a line having a bearing of S 58°30'W; thence 162 feet along a line having a bearing of West; thence 231 feet along a line having a bearing of N 62°30'W to actual point of beginning; thence 452 feet along a line having a bearing of S 62°00'W; thence 108 feet along a line having a bearing of S 45°W; thence southerly along a line having a bearing of South to its intersection with the south line of the NE 1/4 of NE 1/4 of Section 15 and there terminating. Parcel No. 2 (P.I.D. 14-118-22-22-0001) Legal Description: The Northwest Quarter of the Northwest Quarter of Section 14, Township 118, Range 22 except roads. Easement: A permanent easement for storm water ponding purposes over, under, across and thro gh that part of the above described parcel described as follows: Commencing at the NW corner of Section 14; thence southerly along the west line of said section having an assumed bearing of S 0°36'13"W a distance of 735 feet; thence 91 feet along a line having a bearing of N 45°E; thence 223 feet along a line having a bearing of N 21°E; thence 183 feet along line having a bearing of N 60°E; thence 193 feet along a line having a bearing of N 36°30'W; thence 71 feet along a line having a bearing of West; thence S 52°W to its intersection with the west line of Section 14 and there terminating. The motion for the adoption of the foregoing Resolution was duly seconded by • Councilmember Schneider , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport_ a mrilmemhers -rain_ Neils.
