Councilmember Neils introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 85-4
APPROVING REVISED PRELIMINARY PLAT AND VARIANCE FOR DEKOCO COMPANY (81045)
WHEREAS, DeKoco Company has requested approval of a Revised Preliminary Plat and
Variance for three lots on 8.25 acres located north of County Road 9, south of 45th
Avenue North, and generally east of Nathan Lane; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the Revised Preliminary Plat and
Variance for three lots for DeKoco Company on 8.25 acres located north of County Road
9, south of 45th�Avenue North, and generally east of Nathan Lane, subject to the
following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's expense.
3. No Building Permits shall be issued until a Contract has been awarded for sewer
and water.
4. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of issuing Building Permits.
5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open storm
water drainage facility.
6. No Building Permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.
7. No yard setbacks are granted or implied.
8. Approved variances are: Lot width of 162.52 ft. for Lots 1 and 2.
9. The title opinion comments from the City Attorney shall be resolved with the
Final Plat.

10. Appropriate legal documents allowing for the shared drive and access to t,'ie
frontage road, shall be submitted with the Final Plat application, and be filed
and recorded with the Final Plat at Hennepin County, subject to approval by the
City Attorney
11. The Final Plat application shall include appropriate documents addressing
architectural and signage controls, as approved by the City Attorney, and filed
with the Final Plat at Hennepin Countv.
The notion for adoption of the foregoing Resolution was duly seconded by
Councilmember Schneider , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Davenport, Councilmembers Crain- Neils,
Schneider and Vasiliou
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
