Pursuant to due call and notice thereof, a Regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the da of 11L.

Councilmember Schneider introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 84- 904
DIRECTING PREPARATION, INTRODUCTION, AND PROMOTION OF CORRECTIVE LEGISLATION
REGARDING MUNICIPAL COMPREHENSIVE PLANNING AND ZONING
WHEREAS, Minnesota Statutes enable municipalities to adopt and amend comprehensive
plans and to adopt and amend zoning ordinances; and,
WHEREAS, Minnesota Statutes also direct metropolitan municipalities to assure that
official controls such as zoning regulations are consistent with comprehensive plans;
and,
10 WHEREAS, there is a conflict created among those statutory requirements for
metropolitan municipalities which do not have charters in that a less restrictive
vote is required for adoption and amendment of comprehensive plans than is required
for adoption and amendment of zoning regulations; and,
WHEREAS, the Plymouth City Attorney has drafted language which would correct this
conflict by amending Minnesota Statutes Section 462.355, Section 3; and,
WHEREAS, the Association of Metropolitan Municipalities has recognized the conflict
and has acted to endorse corrective legislation such as that drafted by the Plymouth
City Attorney;

MOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does direct the preparation, introduction, and
promotion of corrective legislation regarding comprehensive planning and zoning;
FURTHER, be it resolved that Plymouth legislators be contacted as to the need for
their endorsement and support of this legislation.
The motion for adoption of the foregoing Resolution was duly seowcded by
Councilmember Neils and upon vote being taken thereon, the

Moen and Schneider
