The foUowing metro w s were absent: None CniiVrJ1mPmhPy _Neils introduced the following Resolution and Loved its adoption: RESOLUTION NO. 84-869 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT CONCEPT PLAN FOR HARSTAD-TODD CONSTRUCTION COMPANY (84100) WHEREAS, Harstad-Todd Construction Company has requested approval of a Residential Planned Unit Development Concept Plan for the development of -tingle family residential lots on approximately 108.86 acres located northwest of County Road 9 and Juneau Lane, and northeast of 44th Avenue and Juneau Lane; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Informational Hearing and has recommended approval; NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Re,.idential Planned Unit Development Concept Plan for Harstad-Todd Construction Company for a development to be known as Kingsview Heights consisting of single family residential lots on approximately 108.86 acres located northwest of County Road 9 and Juneau Lane, and northeast of 44th Avenue and Juneau Lane, subject to the following conditionst 1. Compliance with the City Engineer's Memorandum. 2. Staging of the development shall be in accordance with utility availability as approved by the City Engineer. 3. Maximum density shall be 2.3 units per acre for the land at or above the established high water elevation per the adopted City Storm Water Drainage Plan as verified by the City Engineer. Two density bones points are assigned for size of project, and one point is assigned for affirmative design. 4. The preliminary plat/plan application shall address the applicable Shoreland Management Ordinance standards, and wetland regulations. 5. No private drive access shall be permitted to County Road 9 and to Fernbrook Lane; all private drives shall be provided by internal public streets. 6. The preliminary plan/plat shall address the use of the existing structures; filling and capping any existing wells; typical lot layout (lot size, setbacks, and maximum lot coverage); transition to County Road 9 and to Fernbrook Lane; project signage; and, a mass grading plan in sufficient detail to indicate the tree removal in substantial tree cover areas. Transition and buffering shall be provided along the perimeters of the development, with special attention to the developed lots north of 43rd Avenue North. 8. Preliminary Plan/Plat shall show how the outlots, particularly D, E, and F, can be designed and used as open space for the common benefit. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Moen and upon vote being taken thereon tile following: voted n favor thereof.- Mayor avenport, Councilmembers Neils, Moen, rain and Schneider The o ng voted against or abstained: one •hereupon the Resolution was declared duly passed and adopted.
