Pursuant to due call and notice thereof, a Regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the fid.■- day
of— December , 1984. The following members were present: MdYOr Davenport,
ncilmembers Crain Moen, Neils and Schneider
The following members were absent: None
Councilmember Schneider introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 84- 855
AUTHORIZING CONDEMNATION PROCEEDINGS
PROJECT NO. 216
COUNTY ROAD 61 - 6TH AVENUE TO HIGHWAY 12
WHEREAS, the City of Plymouth has undertaken Project No. 216; and
WHEREAS, in order to construct the improvements certain permanent and temporary
easements are required; and
WHEREAS, the City Council finds it necessary, proper and expedient in the
interests of the public health, convenience and general welfare of the citizens
of the City of Plymouth for the City to acquire said easements;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, Minnesota, that the City Attorney is hereby authorized to cosmmenee
condemnation proceeds for Project No. 216 for the following described easements
within the following described parcels:
1. DESCRIPTION OF PARCEL:
The South one-half (1/2) of the North Two-thirds (2/3) of that part of Lot
Twenty-two (22) lying East of the West Oie Hundred (100) feet thereof, Greer's
Orchard Tracts, subject to an easement for .3&d purposes over the West Sixteen
and One-half (16 1/2) feet thereof and tog,cher with an easement for road
purposes and utility purposes over the Ea -,t Sixteen and One-half (16 1/2) feet
of the West One Hundred (100) feet of the North Two-thirds (2/3) of said Lot
Twenty-two (22) and over the West Sixteen and one-half (16 1/2) feet of the
North One-third (1/3) of Lot Twenty-two according to the map or plat thereof on
file and of record in the office of the Register of Deeds in and for the County
of Hennepin and State of Minnesota, including any part or portion of any street
or alley adjacent to said promises heretofore vacated or to be vacated.
Subject to easements, restrictions and reservations of record, if any.
DESCRIPTION OF EASEMENT:
A perpetual easement for drainage and ponding purposes over, under and across
that part of the above described parcel which lies southeasterly of the
folloiwng described line: Beginning at a point on the south line of the above
described parcel distant 65 feet westerly from southeast corner thereof; thence
northeasterly to a point on the east line of said above described parcel
distant 55 feet northerly from said southeast corner of the above described
. land and there terminating.

2. DESCRIPTION OF PARCEL:
The west 1/2 of Lot 23, "Greers Orchard Tracts, Hennepin County, Minnesota,"
according to the recorded plat thereof.
DESCRIPTION OF EASEMENT:
A perpetual easement for drainage and ponding purposes over, under and across
the south 275.00 feet of the above described parcel.
3. DESCRIPTION OF PARCEL:
That part of the East 348.00 feet of the Southeast Quarter of the Southwest
Quarter of Section 34, Township 118 North, Range 22 West, Hennepin County,
Minnesota, lying North of the South 430 feet thereof and lying South of the
center line of County Road No. 15.
DESCRIPTION OF EASEMENT:
A perpetual easement for public right-of-way purposes over, under and across
that part of the above described land which lies Westerly of a line running
parallel with and distant 50.00 feet Easterly of the following described line:
Commencing at the Southeast corner of said Southeast Quarter of the
Southwest Quarter of Section 34, Township 118 North, Range 22 West,
e Hennepin County, Minnesota; thence North 0 degrees 25 minutes 26
seconds West, assumed bearing, a distance of 85.40 feet along the
East line of said Southeast Quarter of the Southwest Quarter to the
point of beginning of the line to be described; thence Northwesterly
a distance of 1,162.38 feet along a nontangential curve concave to
the Northeast having a radius of 1,273.24 feet, a central angle of
52 degrees 18 minutes 36 seconds and a chord bearing of North 20
degrees 54 minutes 32 beconds West; thence North 5 degrees 14 minutes
40 seconds East a distance of 806.24 feet and said line there terinatir.g.
Together with a temporary easement for construction purposes over,
under and across that part of the above described land which lies
Westerly of a line running parallel with and distant 110.00 feet
Easterly of the above described line.
4. DESCRIPTION OF PARCEL:
That part of the South 430.00 feet, of the East 348.00 feet, and that part of
the West 156.22 feet, of the East 504.22 feet of the Southeast Quarter of the
Southwest Quarer, Section 34, Township 110 North, Range 22 West, lying
southerly of the centerline of County Road No. 15.
PURCHASE ENTIRE PARCEL.
. The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Moen , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Davenport, Councilmembers Crain, Moen,
Neils and Schneider
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
