Pursuant to due call and notice thereof, a Regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 3rd day
of December , 1984. The following members were present:
Mayor Davenport. Councilmembers Crain, Neils, Moen and Schneider
The following members were absent:
Councilmember Schneider introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 84- 853
ADOPTING ASSESSMENT - PROJECT NO. 516
SANITARY SEWER AND WATERMAIN AREA - 35-118-22-11-0022, 0023, 0024
WHEREAS, we have received a waiver of assessment hearing from the property
owner the following described property - Lots C, D b E, R.L.S. 356 - waiving
their right to special assessment hearings covering the installation of sani-
tary sewer and watermain area and all other appurtenances;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a
part hereof, is hereby accepted and shall constitute the special assessment
against the lands named therein and each tract of land herein included is
hereby bound to be benefited by the proposed improvement in the amount of
the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending
over a period of 5 years, the first of the installments to be payable on or
before the first Monday in January 1986 and shall bear interest at the rate
of 9.17% per annum from the date of adoption of this assessment resolution.
To the first installment shall be added interest on the entire assessment
from the date of this resolution until December 31, 1986. To each subse-
quent installment when due shall be added interest of one year on all
unpaid installments.
3. The owner of any property so assessed may, at any time prior to certifica-
tion of the assessment to t,ie County Finance Director, pay the whole of the
assessment on such property with interest accrued to the date of payment to
the City Treasurer, except that no interest shall be charged if the entire
assessment is paid within thirty days from the adoption of this resolution;
and he may, at any time thereafter, pay to the City Finance Director the
entire amount of the assessment remaining unpaid with interest accrued to
December 31 of the year in which the payment is aside.
4. The Clerk shall forthwith transmit a certified duplicate of this assessment
to the County Finance Director to be extended on the proper tax lists of
the County and such assessments shall be collected and paid over in the
same manner as other municipal taxes.
5. The total cost of the improvement assessed by this resolution is $7,035.00.
The motion for the adoption of the foregoing Resolution was duly seconded
and upon vote being taken thereon, the
following voted in favor thereof: Mayer Davenoort. Councilmembers Crain.
The following voted against or abstained: None
Whereupon the Resolution was declared duly poessed and adopted.
