Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 19th day
of November 1984. The following members were present: Mayor Davenport,
Councilmember Crain introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 84-809A
AUTHORIZING THE VACATION OF KIMBERLY LANE ADJACENT TO
LOT 3, BLOCK 1, PINECREST 2ND ADDITION
WHEREAS, the petition to vacate a portion of Kimberly Lane adjacent to Lot 3,
Block 1, Pinecrest 2nd Additionwas received by the Council; and
WHEREAS, the public hearing with respect to said vacation was held on
November 19, 1984 in accordance with Minnesota Statutes 412.851, as amended;
and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of November 19, 1984; and
WHEREAS, the Council did hold a public hearing on November 19, 1984 to inform
any and all interested parties relevant to the vacation of said Kimberly Lane;
and
WHEREAS, it was determined by the City Council that Kimberly Lane as described
below is not needed for a public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA as follows:
1. That Kimberly Lane adjacent to Lot 3, Block 1, Pinecrest 2nd Addition
is hereby vacated.
2. That said vacation shall not affect the authority of any person,
corporation or municipality owning or controlling the electric or
telephone poles and lines, gas and sewer lines, or water lines,
mains and hydrants thereon or thereunder, to continue maintaining
the same, to enter upon such way or portion thereof vacated to repair,
replace, remove otherwise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Neils , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Davenport, Councilmembers Neils,
Moen and Crain
The following voted against or abstained: _ none
Whereupon the Resolution was declared duly passed and adopted.
