Councilmemr Schneider introduced the following Resolution and moved its
adoptions
RESOLUTION NO. 84- 808
APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN/PLAT AND CONDITIONAL
USE PERMIT APPLICATION FOR RDC PROPERTIES, INC. (RPUD 84-6) (84030)
WHEREAS, RDC PROPERTIES, INC. has requested approval of a Residential Planned Unit
Development Preliminary Plan/Plat, Rezoning and Conditional Use Permit for a plat of
80 single family detached residential lots and 71 attached units on approximately 41
acres located east of Zachary Lane and north 'of the Zachary Lane Elementary School;
and,
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recoam:ends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the Residential Planned Unit Devel-
opment Preliminary Plan/Plat and Conditional Use Permit for a plat of 80 single fami-
ly detached residential lots and 71 attached units on approximately 41 acres located
east of Zachary Lane and north of the Zachary Lane Elementary School, subject to the
following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's
expense.
3. No Building Permits shall be issued until a contract has been awarded for
municipal sewer and water.
4. Provisions for trail outlots or easements per Comprehensive Park Plan, as
verified by the Parks and Engineering Departments, with submittal of de-
tailed plans as to construction of the trails per City standards, as
follows:
a. A 20 -ft. wide outlot along the southerly side of 46th and 45th Avenues
and the easterly side of Valley Forge Lane.
b. A 30 -ft. wide outlot between Lot 11, Block 5, and Lot 1, Block 6.
c. A 30 -ft. wide easement from Trenton Circle to the northerly property
line within Outlot A. This trail shall be constructed before Building
Permits are issued for Lot 7, Block 1 and for Lot 1, Block 2.

5. Payment of park dedication fees -in -lieu of dedication with appropriate
credits in an amount determined according to verified acreage and paving
costs for the public trail and according to the Dedication Policy in effect
at the time of filing the Final Plat with Hennepin County.
6. Street names shall comply with the City Street Naming System.
7. Compliance with Policy Resolution No. 79-80 regarding minimum floor
elevations for new structures in subdivisions adjacent to, or containing
any open storm water drainage facility.
8. Rezoning shall be finalized with filing of the Final Plat.
9. No Building Permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
10. Appropriate legal documents regarding Homeowner Association documents,
covenants and restrictions as approved by the City Attorney, shall be filed
with the Final Plat.
11. Staging of the development shall be in accordance with utility availability
a-- approved by the City Engineer.
• 12. Maximum density is 4.11 units per acre; and, 80 single-family detached
residential units and one 71 unit multi -family attached structure are
approved.
13. Bonus points are awarded as follows: One point for mix of housing; and one
point for affirmative design.
14. No private drive access shall be permitted to Zachary Lane; all private
drives shall be provided by internal public streets. Private drive access
to 45th and 46th Avenues North shall be prohibited except for Oulot A.
15. Approval of the Land Use Guide Plan Amendment is contingent upon, and
subject to the required review and response by the Metropolitan Council,
and the Final Plat/Plan which shall be approved by the City Council prior
to finalization of the Amendment.
16. The final plan/plat application shall include a detailed landscape plan to
demonstrate maximum berm/buffer between the multi -family area and the
single family dwellings to the north.
The notion for adoption of the foregoing Resolution was duly seconded by
Gouncilmembe r Crain , and upon vote being taken thereon, the
following voted In favor thereof: —Mayor Davennort. Gouncilmembera Neils.

Whereupon the Resolution was declared duly passed and adopted.
