Councilmember Crain introduced the following Resolution and coved its adoption: RESOLUTION No. 84- 785 APPROVING CONDITIONAL USE PERMIT FOR JEROME BEGIN CONSTRUCTION COMPANY FOR LAND RECLAAi- ATION SOUTHEAST OF XENIUM LANE AND COUNTY ROAD 9 (84087) WHEREAS, Jerome Ber=n has requested approval for a Conditional Use Permit to allow land reclamation (tilling and cutting) of approximately 10.9 acres located southeast of Xenium Lane and ':aunty Road 9; and, WHEREAS, thr, Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve a Conditional Use Permit to allow for land reclamation of approximately 10.9 acres located southeast of Xenium Lane and County Road 9, subject to the following: 1. The permit is subject to all applicable codes, regulations and Ordinances. 2. The permit is issued to the petitioner as operator and shall not be transferable. The permit allows for the cut ((approximately 49600 cu.yds.) and fill (approximately 23,000 cu. yds.) of earth only. The permit does not allow a sanitary landfill. 3. The site shall be maintained in a sanitary manner. 4. Hours of operation shall be 8:00 A.M. to 4:30 P.M. S. Operations shall be completed and shall cease by November 30, 1985. 6. Compliance with Policy Resolution No. 84-760 regarding erosion control regulations. 7. An as -built survey shall be submitted at the end of the operation and all disturb- ed areas shall be seeded. 8. A fill permit and Bassett Creek Watershed District approval shall be obtained. All required financial guarantees shall be submitted prior to issuance of the permit. Page two Resolution No. 84- 785 9. &:-il boring test results shall be submitted or a certified affadavit listing sanitary landfill materials already placed on the property shall be submitted prior to issuance of the permit. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following voted n favor thereof: Acting Mayor Schneider, Councilmembers Neils and �^ain ne following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
