. Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the 5th day of Noyamber . 1964.
The following members were present: Acting Mayor Schneider, Counci me ers ells —
and Crain
The following members were absent: Mayor Davenport, Counci mem er Moen
Councilmember Neils introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 84- 774
APPROVING VARIANCE FROM THE URBAN DEVELOPMENT POLICY RESOLUTION NO. 75-664 FOR ROSE-
WOOD CORPORATION (84084)
WHEREAS, Rosewood Corporation has requested approval of a Variance from the Urban
Development Policy Resolution No. 75-664, to develop the subject property prior to the
extension of public utilities for property located west of County Road 18 Service Road
and north of the Railroad Tracks in Section 1; and,
WHEREAS, the Planning Commission has reviewed the request and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the request for Rosewood Corporation for
a Variance from the Urban Development Policy Resolution No. 75-664 for property located
west of County Road 18 Service Road and north of the Railroad Tracks in Section 1, sub-
ject to the following:
1. Compliance with the Engineer's Memorandum.
2. The variance is approved on the basis that the petitioner has demonstrated there
Is a unique situation to the proposed development of the property and that the
criteria as stated in the Policy Resolution No. 75-664 are complied with. The
proposed development would generate a limited amount of sanitary sewage not exce-
eding that of a single family home; a temporary service can be provided and
measures will be taken to ensure the future connection to permanent municipal
service.
3. The platting and site plan applications shall not be processed prior to the sub-
mittal of required plat applications for the Scherer Brothers Lumber Co. property.
4. The anticipated development plans of the subject property shall be subject to the
required Ordinance reviews. No approval is granted or implied at this time for a
specific development plan.
5. The appropriate legal documents and financial guarantees, as approved by the City
Engineer, shall be submitted prior to filing of the final plat guaranteeing the
Installation and connection to gravity sanitary sewer service when available, as
determined by the City of Plymouth.

6. Temporary sanitary sewer service shall be designed in accordance with City
standards, reviewed with the platting applications, and approved by the City
Engineer.
7. The amount of sanitary sewer to be generated shall be limited to the equivalency
of one residential unit.
8. This approval is also based upon the development being served with municipal water
at the time of construction.
The wotion for adoption of the foregoing Resolution was duly seconded by
Councilmember SEhneider , and upon vote being taken thereon, the
following voted in favor thereof: Acting Mayor Schneider, Councilmembers Neils
and Crain
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
